8787 (a) "Parent portal" means the posting the state board is required to provide under this

101101 perpetrator, or bystander of bullying, cyber-bullying, hazing, retaliation, or

103103 abusive conduct such as:

107107 (B) options for the student to make changes to the student's educational

129129 (v) be informed of the steps and resources for seeking accommodations under state or

166166 (A) the comparison tool created under Section 53G-6-805;

168168 (B) school level safety data, including data points described in Section 53E-3-516;

172172 (C) a link to the public safety portal described in Section 63A-16-1002; and

174174 (ii) may include in the parent portal other information that the state board determines

178178 (3)(a) The state board shall post the parent portal at a location that is easily located by a

245245 (i) a district school;

280280 (A) that an LEA selects under Section 53G-10-402;

282282 (B) for a concurrent enrollment course that contains sensitive material and for

284284 which a parent receives notice from the course provider of the material before

286286 enrollment of the parent's child and gives the parent's consent by enrolling the

292292 (D) for family and consumer science courses; or

294294 (E) for another course the state board exempts in state board rule.

296296 (iii) "Subjective sensitive material" means an instructional material that constitutes

298298 pornographic or indecent material, as that term is defined in Section 76-10-1235,

300300 under the following factor-balancing standards:

302302 (A) material that is harmful to minors under Section 76-10-1201;
303303 147
304304 (B) material that is pornographic under Section 76-10-1203; or
305305 148
306306 (C) material that includes certain fondling or other erotic touching under
307307 149
308308 Subsection 76-10-1227(1)(a)(iv).

310310 (j) "UETN" means the Utah Education and Telehealth Network, created in Section
311311 151
312312 53B-17-105.

314314 (k)(i) "Vendor" means an entity that provides digital instructional material to students

316316 in a school setting:
317317 154
318318 (A) under a contract with a contracting entity; or
319319 155
320320 (B) through donating the digital instructional material.

322322 (ii) "Vendor" does not include an internet service provider, as that term is defined in
323323 157
324324 Section 76-10-1230.

326326 (2)(a) Sensitive materials are prohibited in the school setting.

328328 (b) A public school or an LEA may not:
329329 160
330330 (i) adopt, use, distribute, provide a student access to, or maintain in the school setting,

332332 sensitive materials; or

334334 (ii) permit a speaker or presenter in the school setting to display or distribute

336336 sensitive materials.

338338 (c) In evaluating, selecting, or otherwise considering action related to a given

341341 instructional material under this section, each public school and each LEA shall

343343 prioritize protecting children from the harmful effects of illicit pornography over
344344 167
345345 other considerations in evaluating instructional material.

347347 (d) If an instructional material constitutes objective sensitive material:
348348 169
349349 (i) a public school or an LEA is not required to engage in a review under a subjective
350350 170
351351 sensitive material standard; and
352352 171
353353 (ii) the outcome of a subjective sensitive material evaluation has no bearing on the
354354 172
355355 non-discretionary objective sensitive material conclusion.

357357 (3)(a) Except as provided in Subsection (3)(b), the following individuals may initiate a
358358 174
359359 sensitive material review under this section:
360360 175
361361 (i) an employee of the relevant LEA;
362362 176
363363 (ii) a student who is enrolled in the relevant LEA;
364364 177
365365 (iii) a parent of a child who is enrolled in the relevant LEA; or
366366 178
367367 (iv) a member of the relevant LEA governing board.

369369 (b)(i) As used in this Subsection (3)(b), "unsuccessful challenge" means an allegation
370370 180
371371 that a given instructional material constitutes sensitive material that the LEA
372372 181
373373 concludes to be erroneous, either on direct review or on appeal to the LEA
374374 182
375375 governing board, resulting in the retention of the given instructional material.

377377 (ii) Notwithstanding Subsection (3)(a), after an individual makes three unsuccessful
378378 184
379379 challenges during a given academic year, the individual may not trigger a
380380 185
381381 sensitive material review under this section during the remainder of the given
382382 186
383383 academic year.

385385 (4) Upon receipt of an allegation from an individual described in Subsection (3)(a), an LEA
386386 188
387387 shall:
388388 189
389389 (a)(i) make an initial determination as to whether the allegation presents a plausible
390390 190
391391 claim that the challenged instructional material constitutes sensitive material,
392392 191
393393 including whether the allegation includes excerpts and other evidence to support
394394 192
395395 the allegation; and
396396 193
397397 (ii) if the LEA determines that the allegation presents a plausible claim that the
398398 194
399399 challenged instructional material constitutes sensitive material under Subsection
400400 195
401401 (4)(a)(i), immediately remove the challenged material from any school setting that
402402 196
403403 provides student access to the challenged material until the LEA completes the
404404 197
405405 LEA's full review of the challenged material under this section;
406406 198
407407 (b)(i) engage in a review of the allegations and the challenged instructional material

412412 (ii) if the LEA makes a determination that the challenged instructional material

414414 constitutes objective sensitive material, ensure that the material remains

416416 inaccessible to students in any school setting;

418418 (c) only if the LEA makes a determination that the challenged instructional material
419419 204
420420 does not constitute objective sensitive material:
421421 205
422422 (i) review the allegations and the challenged instructional material under the
423423 206
424424 subjective material standards, ensuring that the review includes parents who are
425425 207
426426 reflective of the members of the school's community when determining if an
427427 208
428428 instructional material is subjective sensitive material;
429429 209
430430 (ii) allow student access to the challenged instructional material during the LEA's
431431 210
432432 subjective sensitive material review if the student's parent gives consent regarding
433433 211
434434 the specific challenged instructional material; and
435435 212
436436 (iii) if the LEA makes a determination that the challenged instructional material
437437 213
438438 constitutes subjective sensitive material, ensure that the material is inaccessible to
439439 214
440440 students in any school setting, including the termination of the parent consent
441441 215
442442 option described in Subsection (4)(c)(ii); and
443443 216
444444 (d) communicate to the state board:
445445 217
446446 (i) the allegation[ and ] ;
447447 218
448448 (ii) the LEA's final determination regarding the allegation and the challenged
449449 219
450450 instructional material[.] ; and
451451 220
452452 (iii) if the challenged instructional material is digital material, the vendor providing
453453 221
454454 access to the digital material.

456456 (5)(a) An individual described in Subsection (3)(a) may appeal an LEA's decision
457457 223
458458 regarding a sensitive material review, regardless of whether the LEA removed or
459459 224
460460 retained the challenged instructional material, to the LEA governing board.

462462 (b) An LEA governing board shall vote in a public board meeting to decide the outcome
463463 226
464464 of a sensitive material review appeal, clearly identifying:
465465 227
466466 (i) the board's rationale for the decision; and
467467 228
468468 (ii) the board's determination on each component of the statutory and any additional
469469 229
470470 policy standards the board uses to reach the board's conclusions.

472472 (6) An LEA governing board may not enact rules or policies that prevent the LEA

474474 governing board from:

476476 (a) revisiting a previous decision;

479479 (b) reviewing a recommendation of LEA personnel or a parent-related committee

483483 (c) reconsidering a challenged instructional material if the LEA governing board

485485 receives additional information regarding the material.

487487 (7)(a) Except as provided in Subsection (7)(d), if the threshold described in Subsection

489489 (7)(b) is met, each LEA statewide shall remove the relevant instructional material

491491 from student access.

493493 (b) The requirement described in Subsection (7)(a) to remove a given material from
494494 241
495495 student access applies if the following number of LEAs makes a determination that a

497497 given instructional material constitutes objective sensitive material:

499499 (i) at least three school districts; or

501501 (ii) at least two school districts and five charter schools.

503503 (c) The state board shall:

505505 (i) aggregate allegations and LEA determinations described in Subsection (4)(d); and

507507 (ii) no later than 10 school days after the day on which the condition described in
508508 248
509509 Subsection (7)(b) occurs, communicate to all LEAs the application of the
510510 249
511511 requirement described in Subsection (7)(a) to remove the material from student
512512 250
513513 access.

515515 (d)(i) When the threshold described in Subsection (7)(b) is met for a given
516516 252
517517 instructional material, in addition to making the communication described in
518518 253
519519 Subsection (7)(c), the state board may:

521521 (A) place the material on the agenda of a public board meeting within 60 days
522522 255
523523 after the day on which the state board makes the communication to LEAs
524524 256
525525 under Subsection (7)(c); and
526526 257
527527 (B) at the specified state board meeting, vote to overturn the application of the
528528 258
529529 requirement described in Subsection (7)(a) to remove a given material from
530530 259
531531 student access statewide.

533533 (ii) If the state board votes to overturn the application of the statewide removal
534534 261
535535 requirement described in Subsection (7)(a) under Subsection (7)(d)(i):

537537 (A) the statewide removal requirement described in Subsection (7)(a) no longer

539539 applies;

541541 (B) an LEA may choose to return the given material to student access; and

543543 (C) nothing affects the findings of an LEA governing board regarding removal of

545545 the given material within the board's LEA.

548548 (e) Each LEA, the state board, and UETN shall remove student access that the LEA,

550550 state board, or UETN facilitates to any material that a vendor provides if three

552552 separate items of digital instructional material that the vendor provides are subject to
553553 270
554554 statewide removal under this section.

556556 [(e)] (f) This Subsection (7) applies to sensitive materials that LEAs remove from student
557557 272
558558 access, regardless of whether:
559559 273
560560 (i) the sensitive material determinations occur in the same academic year; or
561561 274
562562 (ii) a sensitive material determination occurred before July 1, 2024.

564564 (8) The state board shall:
565565 276
566566 (a) in consultation with the Office of the Attorney General, provide guidance and
567567 277
568568 training to support public schools in identifying instructional materials that meet the
569569 278
570570 definition of sensitive materials under this section;

572572 (b) establish a process through which an individual described in Subsection (3)(a) may
573573 280
574574 report to the state board an allegation that an LEA is out of compliance with this
575575 281
576576 section; and
577577 282
578578 (c) annually report to the Education Interim Committee, at or before the November
579579 283
580580 interim meeting, on implementation and compliance with this section, including:
581581 284
582582 (i) any policy the state board or an LEA adopts to implement or comply with this
583583 285
584584 section;

586586 (ii) any rule the state board makes to implement or comply with this section; and
587587 287
588588 (iii) any complaints an LEA or the state board receives regarding a violation of this
589589 288
590590 section, including:
591591 289
592592 (A) action taken in response to a complaint described in this Subsection (8)(c)(iii);

594594 (B) if an LEA retains an instructional material for which the LEA or the state
595595 291
596596 board receives a complaint, the LEA's rationale for retaining the instructional
597597 292
598598 material; and
599599 293
600600 (C) compliance failures that the state board identifies through the reporting
601601 294
602602 process described in Subsection (8)(b) and other investigations or research.

604604 (9) The state shall defend, indemnify, and hold harmless a person acting under color of state
605605 296
606606 law to enforce this section for any claims or damages, including court costs and attorney
607607 297
608608 fees, that:
609609 298
610610 (a) a person brings or incurs as a result of this section; and
611611 299
612612 (b) is not covered by the person's insurance policies or any coverage agreement that the
613613 300
614614 State Risk Management Fund issues.

617617 (10) Subject to prioritization of the Audit Subcommittee created in Section 36-12-8, the

619619 Office of the Legislative Auditor General shall:

621621 (a) conduct an audit of each school district's compliance with this section, ensuring the

623623 completion of all school district audits before November 2028; and
624624 305
625625 (b) annually report to the Education Interim Committee regarding completed sensitive
626626 306
627627 material audits under this Subsection (10).

629629 (11)(a) At the time of student registration each year, each LEA shall provide to parents:

639637 (b) Each LEA website shall maintain an easily accessible and clearly visible section on

641639 the website's homepage for reporting violations of law regarding sensitive material.

643641 (12)(a) The state board, an LEA, or UETN may refuse donations of materials by a

645643 vendor or nonprofit if the materials contain sensitive material.

647645 (b) A contracting entity may, without any penalty or any further financial obligation,
648646 316
649647 rescind or otherwise terminate a contract for a vendor to provide instructional
650648 317
651649 material into which the contracting entity enters on or after July 1, 2025, after three
652650 318
653651 instances of:

655653 (i)(A) for material under a contract of an LEA, the LEA governing board
656654 320
657655 determining that the digital instructional material is or contains objective
658656 321
659657 sensitive material; or
660658 322
661659 (B) for material under a contract of the state board or UETN, an LEA reporting
662660 323
663661 that the LEA governing board has determined that the digital instructional
664662 324
665663 material is or contains objective sensitive material; and

667665 (ii) within 30 school days after the day on which the contracting entity provides
668666 326
669667 notice of a determination described in Subsection (12)(a)(i), the vendor failing to
670668 327
671669 eliminate the segment of the digital instructional material containing the objective
672670 328
673671 sensitive material or otherwise remove access to the sensitive material.

675673 (c) In any contract for a vendor to provide digital instructional material for which the
676674 330
677675 parties negotiate terms and into which the parties enter on or after July 1, 2025, the
678676 331
679677 contracting entity shall ensure that the contract contains:
680678 332
681679 (i) notice provisions regarding the requirements and prohibitions regarding digital
682680 333
683681 sensitive material in this section, including any relevant rule or policy of the
