Stratton 2 3 LONG TITLE 4 General Description: 5 This bill addresses reporting on federal rules and directives. 6 Highlighted Provisions: 7 This bill: 8 ▸ requires certain state agencies to annually report interpretations of federal rules and 9 directives; and 10 ▸ includes a coordination clause to amend Section 26B-1-244 enacted in H.B. 527, Federal 11 Requirements Reporting, if this bill and S.B. 198, Federal Guidance Letter 12 Amendments, both pass and become law. 13 Money Appropriated in this Bill: 14 None 15 Other Special Clauses: 16 This bill provides a coordination clause. 17 Utah Code Sections Affected: 18 ENACTS: 19 26B-1-244, Utah Code Annotated 1953 20 53E-1-207, Utah Code Annotated 1953 21 Utah Code Sections affected by Coordination Clause: 22 26B-1-244, Utah Code Annotated 1953 23 24 Be it enacted by the Legislature of the state of Utah: 25 The following section is affected by a coordination clause at the end of this bill. 26 Section 1. Section 26B-1-244 is enacted to read: 27 26B-1-244 . Department report on federal health rules and directives. 28 On or before July 1 of each calendar year, the department shall submit to the Health and 29 Human Services Interim Committee and the Federalism Commission a report that includes 1st Sub. (Buff) H.B. 527 03-04 16:26 30 each interpretation from the United States Department of Health and Human Services that 31 provides guidance to the department regarding the implementation of United States 32 Department of Health and Human Services rules or directives. 33 Section 2. Section 53E-1-207 is enacted to read: 34 53E-1-207 . State board report on federal education rules and directives. 35 On or before July 1 of each calendar year, the state board shall submit to the Education 36 Interim Committee and the Federalism Commission a report that includes each interpretation 37 from the United States Department of Education that provides guidance to the state board or an 38 LEA regarding the implementation of United States Department of Education rules or 39 directives. 40 Section 3. Effective Date. 41 This bill takes effect on May 7, 2025. 42 Section 4. Coordinating H.B. 527 with S.B. 198. 43 If H.B. 527, Federal Requirements Reporting, and S.B. 198, Federal Guidance Letter 44 Amendments, both pass and become law, the Legislature intends that, on May 7, 2025, Section 45 26B-1-244 enacted in H.B. 527 be amended to read: 46 "On or before July 1 of each calendar year, the department shall submit to the Health and 47 Human Services Interim Committee and the Federalism Commission a report that includes 48 each federal guidance letter, as defined in Section 63G-16-201, from the United States 49 Department of Health and Human Services regarding the implementation of United States 50 Department of Health and Human Services rules or directives.". - 2 -
