This bill addresses notification of usage of water by end users.

Be it enacted by the Legislature of the state of Utah:
25 
Section 1.  Section 73-10-32.7 is enacted to read:
26 
73-10-32.7 . Water use escalation notifications.
27 
(1) As used in this section:
28 
(a) "Fully metered" means the same as the term "fully metering" is defined in Section
29 
73-10-34.

(b) "Public water system" means the same as that term is defined in Section 19-4-102.

(c) "Retail water supplier" means the same as that term is defined in Section 19-4-102.

(d) "Secondary water supplier" means the same as that term is defined in Section
33 
73-10-34.

(2) On and after July 1, 2027, a retail water supplier shall administer an automated system
35 
under which the retail water supplier:
36 
(a) measures water usage by an end user;
37 
(b) records the amounts used by an end user; and
38 
(c) notifies an end user when the end user's water use significantly escalates during a
39 
month.
40 
(3)(a) For a secondary water supplier that is fully metered on July 1, 2027, on and after
41 
July 1, 2027, the secondary water supplier shall administer an automated system
42 
under which the secondary water supplier:
43 
(i) measures water usage by an end user;
44 
(ii) records the amounts used by an end user; and
45 
(iii) either directly or through the public water system that serves an end user of the
46 
secondary water supplier, notifies an end user when the end user's water use
47 
significantly escalates during a month.
48 
(b) For a secondary water supplier that is not described in Subsection (3)(a), within six
49 
months of the day on which the secondary water supplier is fully metered, the
50 
secondary water supplier shall administer an automated system under which the
51 
secondary water supplier:
52 
(i) measures water usage by an end user;
53 
(ii) records the amounts used by an end user; and
54 
(iii) either directly or through the public water system that serves an end user of the
55 
secondary water supplier, notifies an end user when the end user's water use
56 
significantly escalates during a month.
57 
(c) Notwithstanding whether a secondary water supplier is fully metered, by no later
58 
than July 1, 2031, the secondary water supplier shall administer an automated system
59 
under which the secondary water supplier:
60 
(i) measures water usage by an end user;
61 
(ii) records the amounts used by an end user; and
62 
(iii) either directly or through the public water system that serves an end user of the
63 
secondary water supplier, notifies an end user when the end user's water use
64 
significantly escalates during a month.

(4) The Division of Water Resources, shall make rules, in accordance with Title 63G,
66 
Chapter 3, Utah Administrative Rulemaking Act:
67 
(a) defining what constitutes "significantly escalates"; and
68 
(b) outlining best practices in measuring when usage during a month significantly
69 
escalates.
70 
(5) Notification under this section may be made:
71 
(a) electronically or by first-class United States mail; and
72 
(b) on a monthly statement, by separate notice, or by an end user specific Internet portal
73 
that provides information on the end user's usage more frequently than monthly.
74 
(6) This section does not apply to a secondary water supplier that is:
75 
(a) exempt from metering under Subsection 73-10-34(9), (10), or (11); or
76 
(b) authorized to meter at strategic points of the system under Subsection 73-10-34(13).

(7) This section does not create a cause of action against a retail water supplier or secondary
78 
water supplier for an act or failure to act under this section.

Section 2.  Effective Date.
80 
This bill takes effect on May 7, 2025.
