41 | 41 | | Section 1. Section 53-22-108 is enacted to read: |

45 | 45 | | (1) As used in this section: |
---|

47 | 47 | | (a) "Authorized foundation" means a nonprofit foundation that: |
---|

---|
49 | 49 | | (i) meets the requirements of this section; and |
---|
50 | 50 | | 23 |
---|
51 | 51 | | (ii) the state security chief authorizes in consultation with the School Safety Center |
---|
52 | 52 | | 24 |
---|
53 | 53 | | created in Section 53G-8-802. |
---|
54 | 54 | | 25 |
---|
55 | 55 | | (b) "School safety product" means equipment, technology, service, or material that |
---|
56 | 56 | | 26 |
---|
57 | 57 | | enhances school safety and security. |
---|

---|
59 | 59 | | (2) The state security chief may approve a nonprofit foundation to be an authorized |
---|
60 | 60 | | 28 |
---|
61 | 61 | | foundation if the foundation: |

---|
63 | 63 | | (a) maintains status as a nonprofit organization under 26 U.S.C. Sec. 501(c)(3); |
---|

65 | 65 | | (b) has operated continuously in the state for three or more years; |

---|
74 | 74 | | (ii) an educator or school administrator; and |

---|
76 | 76 | | (iii) an emergency management professional; |

---|
78 | 78 | | (e) demonstrates financial stability through: |
---|
79 | 79 | | 37 |
---|
80 | 80 | | (i) an annual independent audit; |
---|

---|
82 | 82 | | (ii) maintained reserves; and |
---|

---|
84 | 84 | | (iii) a clean financial record; and |

86 | 86 | | (f) provides evidence of: |

---|
88 | 88 | | (i) successful project management; |

---|
90 | 90 | | (ii) an existing relationship with an educational institution; and |

92 | 92 | | (iii) knowledge of school safety requirements described in federal and state law. |

94 | 94 | | (3) A foundation seeking authorization shall submit to the state security chief: |
---|

96 | 96 | | (a) a written application that demonstrates compliance with Subsection (2); |
---|

98 | 98 | | (b) a financial record for the previous three years; |
---|
99 | 99 | | 47 |
---|
100 | 100 | | (c) a current board member qualification; |
---|
101 | 101 | | 48 |
---|
102 | 102 | | (d) a proposed school safety initiative; and |
---|
103 | 103 | | 49 |
---|
104 | 104 | | (e) an internal procurement policy for purchases not made from a state cooperative |
---|
105 | 105 | | 50 |
---|
106 | 106 | | contract. |

108 | 108 | | (4) The state security chief shall: |

110 | 110 | | (a) review an application within 60 days; |
---|

112 | 112 | | (b) request additional information if needed; |

---|
114 | 114 | | (c) issue a written decision; and |

---|
116 | 116 | | (d) maintain a public record of an authorized foundation, including records related to the |
---|

118 | 118 | | approval process of an authorized foundation. |

120 | 120 | | (5) An authorized foundation may: |
---|

---|
122 | 122 | | (a) use a state cooperative contract in accordance with Section 63G-6a-2105; |
---|

124 | 124 | | (b) make a bulk purchase of a school safety product; and |
---|

---|
126 | 126 | | (c) in coordination with the state security chief and the School Safety Center: |
---|

128 | 128 | | (i) facilitate a donation of a school safety product; and |
---|
129 | 129 | | 62 |
---|
130 | 130 | | (ii) distribute a product to a school. |
---|

132 | 132 | | (6) An authorized foundation shall: |

134 | 134 | | (a) follow Title 63G, Chapter 6a, Utah Procurement Code, when utilizing a state |

139 | 139 | | (b) maintain separate accounting for a school safety purchase; |

141 | 141 | | (c) by August 1 of each year, submit an annual report to the state security chief that |
---|

145 | 145 | | (i) any product procured through a state cooperative contract; |

147 | 147 | | (ii) the annual independent audit required in Subsection (2)(e); |

151 | 151 | | (iv) the total value of a donation facilitated; and |

155 | 155 | | (d) renew authorization every three years. |

159 | 159 | | (a) may revoke authorization if the authorized foundation: |

161 | 161 | | (i) fails to maintain a requirement of this section; |
---|

163 | 163 | | (ii) engages in financial mismanagement; or |
---|
164 | 164 | | 79 |
---|
165 | 165 | | (iii) submits false information in a report required by this section; and |
---|

167 | 167 | | (b) shall, before revoking authorization: |

169 | 169 | | (i) provide written notice to the foundation; |
---|

---|
171 | 171 | | (ii) allow a 30-day period to remedy the violation; |
---|

---|
173 | 173 | | (iii) provide an opportunity for a hearing; and |
---|

175 | 175 | | (iv) issue a final written decision. |
