41	41	Be it enacted by the Legislature of the state of Utah:

43	43	Section 1. Section 53G-10-403 is amended to read:

45	45	53G-10-403 . Required parental consent for sex education instruction.

47	47	(1) As used in this section:

49	49	(a)(i) "Sex education instruction" means, for the purpose of the parental consent
50	50	23
51	51	requirement in this section, any course material, unit, class, lesson, activity, or
52	52	24
53	53	presentation that, as the focus of the discussion, provides instruction or
54	54	25
55	55	information [to a student about] about the following topics:
56	56	26
57	57	(A) sexual abstinence;
58	58	27
59	59	[(B) human sexuality;]
60	60	28
61	61	[(C)] (B) human reproduction;
62	62	29
63	63	[(D)] (C) reproductive anatomy;

65	65	[(E)] (D) physiology;

88	88	(b) "School" means the same as that term is defined in Section 53G-10-205.

90	90	(2)(a) A school shall obtain prior written consent from a student's parent before the
91	91	43
92	92	school may provide sex education instruction to the student.

94	94	(b) Notwithstanding receipt of the consent described in Subsection (2)(a), a school may

96	96	not provide sex education instruction that is not provided in the curriculum described
97	97	46
98	98	in Section 53G-10-402.

100	100	(3) If a student's parent chooses not to have the student participate in sex education

102	102	instruction, a school shall:

104	104	(a) waive the requirement for the student to participate in the sex education instruction;

108	108	(b) provide the student with a reasonable alternative to the sex education instruction

110	110	requirement.

112	112	(4) In cooperation with the student's teacher or school, a parent shall take responsibility for

114	114	the parent's student's sex education instruction if a school:

116	116	(a) waives the student's sex education instruction requirement in Subsection (3)(a); or

118	118	(b) provides the student with a reasonable alternative to the sex education instruction

120	120	requirement described in Subsection (3)(b).

122	122	(5) A student's academic or citizenship performance may not be penalized if the student's

124	124	parent chooses not to have the student participate in sex education instruction as

126	126	described in Subsection (3).
