2525 Be it enacted by the General Assembly of Virginia:

2727 1. That the Code of Virginia is amended by adding a section numbered 2.2-213.6 as follows:

2929 2.2-213.6. Secretary to conduct regular review of surgical informed consent provisions; report.

3131 Every five years, the Secretary, in consultation with the Department of Health Professions, shall conduct a review of all informed consent procedures, forms, and processes for surgeries. Such review shall include any hospital that performs surgeries. The review shall address (i) the effectiveness of existing surgical informed consent procedures in informing patients about their surgeries; (ii) the differences in informed consent procedures among different hospitals for the same or similar surgeries; (iii) any informed consent procedures for surgeries that the Secretary determines are inadequate to properly inform patients; and (iv) recommendations for the improvement of informed consent procedures. The Secretary shall provide a report on the review to the Chairmen of the House Committee on Health and Human Services and the Senate Committee on Education and Health every five years.
