15 | 23 | 1. That the Code of Virginia is amended by adding a section numbered 4.1-206.4 as follows: | |

17 | 25 | 4.1-206.4. Requirements for certain licensees; provision of free potable water; civil penalty. | |

19 | 27 | A. For the purposes of this section, "potable water" means water that is safe for human consumption. | |

21 | 29 | B. Persons licensed to sell alcoholic beverages at retail for on-premises consumption shall ensure that free potable water is available upon request to customers who have placed an order. | |

23 | 31 | C. Any person determined by the Board to have violated this section shall be subject to a (i) written warning for a first offense and (ii) civil penalty as provided for in 4.1-227 for any second or subsequent offense that occurs within three years of the first offense. | |

25 | 33 | D. The provisions of this section shall not apply to persons granted a license pursuant to subsection D of 4.1-206.3. |
