AMENDMENT IN THE NATURE OF A SUBSTITUTE

A BILL to amend the Code of Virginia by adding in Chapter 23 of Title 56 a section numbered 56-596.5, relating to electric utilities; high-energy user report.

 

Be it enacted by the General Assembly of Virginia:

1. That the Code of Virginia is amended by adding in Chapter 23 of Title 56 a section numbered 56-596.5 as follows:

 56-596.5. High-energy user report.

A. For the purposes of this section, "high-energy user" means any customer whose most demand during the most recent calendar year was 25 megawatts or greater or whose anticipated annual demand is 25 megawatts or greater.

B. Each electric utility shall submit to the Commission a quarterly energy source report that describes the total amount of energy consumed by the data center in the previous quarter, disaggregated by the energy source, by each high-energy user. The Commission shall aggregate the total energy consumption of all high-energy users in the Commonwealth and publish a report that provides the percentage of each energy source relative to the total energy consumption of all high-energy users. The Commission shall make such report publicly available on its website and submit it to the Chairmen of the House Committees on Labor and Commerce and on Agriculture, Chesapeake and Natural Resources and the Senate Committees on Commerce and Labor and Agriculture, Conservation and Natural Resources by November 30, 2026, and on a quarterly basis thereafter. The Commission shall withhold information submitted or obtained pursuant to this section from public disclosure if such information could jeopardize national security or the safety or security of the electric grid is disclosed to the public. Upon request of the owner or operator of a high-energy user or its designee, the Commission may redact or omit from public disclosure any information submitted by the electric utility pursuant to this section if the Commission determines such information to be confidential or commercially sensitive.
