SENATE BILL NO. 1490

AMENDMENT IN THE NATURE OF A SUBSTITUTE

A BILL to amend and reenact 13.01, as amended, of Chapter 116 of the Acts of Assembly of 1948, which provided a charter for the City of Richmond, relating to director of public utilities; qualifications.

 

Be it enacted by the General Assembly of Virginia:

1. That 13.01, as amended, of Chapter 116 of the Acts of Assembly of 1948 is amended and reenacted as follows:

 13.01. Department of public utilities; created; composition; qualifications of director.

A. There shall be a department of public utilities which shall consist of the director of public utilities and such other officers and employees organized into such bureaus, divisions and other units as may be provided by ordinance or by the orders of the director consistent therewith. The director shall have power to make rules and regulations consistent with this charter and the ordinances of the city for the conduct of its business.

B. The director of public utilities shall possess the following minimum qualifications:

1. A bachelor's degree in engineering, infrastructure management, or a related field from an accredited institution or a professional certification relevant to public utilities or works, such as licensure as a Professional Engineer (PE), Certified Public Works Professional-Management (CPWP-M), or an equivalent certification approved by the City Council; and

2. At least five years of professional experience in public works, utilities, infrastructure management, or a related field.

The city may establish additional qualifications for the position of director of public utilities that exceed the minimum qualifications set forth herein.

2. That the requirements of Chapter 2 ( 15.2-200 et seq.) of Title 15.2 of the Code of Virginia shall be deemed to have been satisfied by the passage of this act.
