AMENDMENT IN THE NATURE OF A SUBSTITUTE

A BILL to amend the Code of Virginia by adding in Title 32.1 a chapter numbered 21, consisting of a section numbered 32.1-376, relating to contraception; right to access; exception.

Be it enacted by the General Assembly of Virginia:

1. That the Code of Virginia is amended by adding in Title 32.1 a chapter numbered 21, consisting of a section numbered 32.1-376, as follows:

CHAPTER 21.

CONTRACEPTION.

 32.1-376. Right to access contraception; exception.

A. It is the public policy of the Commonwealth that, independently of the requirements of the Constitution of the United States, individuals possess the right to access contraception as set forth in Griswold v. Connecticut, 381 U.S. 479 (1965), and Eisenstadt v. Baird, 405 U.S. 438 (1972).

B. Notwithstanding the provisions of subsection A, no private institution or physician, or any agent or employee of such institution or physician, shall be prohibited from refusing to provide contraception or contraceptive procedures, supplies, or information if such refusal is based upon religious or conscientious objection, and no such institution, physician, agent, or employee shall be held liable for such refusal.
