25 | 25 | Be it enacted by the General Assembly of Virginia: | |

27 | 27 | 1. 1. The Safety and Health Codes Board (the Board) shall promulgate regulations to establish a THC impairment standard and testing protocol to be used exclusively on manufacturing and utility work sites. All state agencies and institutions of higher education shall assist the Board in developing such regulations. In developing such regulations, the Board shall consider regulations promulgated by the U.S. Department of Defense. Regulations adopted by the Board under this act shall be subject to the requirements of the Administrative Process Act ( 2.2-4000 et seq. of the Code of Virginia), and the rulemaking process shall be commenced no later than October 1, 2025. |
