1111 Statement of purpose of bill as introduced: This bill proposes to prohibit the 6
1212 use of animals in product testing, with some exceptions. 7
1313 An act relating to prohibiting the use of animals in product testing 8
1414 It is hereby enacted by the General Assembly of the State of Vermont: 9
1515 Sec. 1. 20 V.S.A. chapter 194, subchapter 5 is added to read: 10

1717 § 3941. PROHIBITED USE OF ANIMALS IN PRODUCT TESTING 12
1818 (a) As used in this section: 13
1919 (1) “Alternative test method or strategy” means a test method, including 14
2020 a new or revised method, that: 15
2121 (A) does not use animals; 16
2222 (B) provides information of equivalent or better scientific quality and 17

2828 (C) includes computational toxicology and bioinformatics, high 1
2929 throughput screening methods, testing categories of chemical substances, 2
3030 tiered testing methods, in vitro studies, and microphysiological systems. 3
3131 (2) “Animal” means any nonhuman vertebrate. 4
3232 (3) “Biomedical research” means the investigation of the biological 5
3333 processes and causes of disease or research conducted to increase fundamental 6
3434 scientific knowledge or to expand the understanding about how processes in 7
3535 living organisms develop and function. “Biomedical research” does not 8
3636 include testing done to assess the safety or efficacy of chemicals, ingredients, 9
3737 drugs, vaccines, product formulations, or products. 10
3838 (4) “Product testing facility” means an entity, institution, business 11
3939 partnership, corporation, association, or other legal relationship that tests 12
4040 chemicals, ingredients, drugs, vaccines, product formulations, or products. 13
4141 (5) “Traditional animal test method” means a process, procedure, or 14
4242 experiment using animals to obtain information on the characteristics of a 15
4343 chemical, ingredient, drug, vaccine, product formulation, or product and that 16
4444 generates information regarding the ability of the chemical, ingredient, drug, 17
4545 vaccine, product formulation, or product to produce a specific biological effect 18
4646 under specified conditions. 19
4747 (b)(1) A product testing facility operating in the State shall not use a 20

5353 regulating the specific product or activity for which the test method is being 1
5454 used has either approved an alternative test method or strategy or granted a 2
5555 waiver exempting a product or activity from the required traditional animal test 3
5656 method. 4
5757 (2) When there is not an alternative test method or strategy or waiver 5
5858 available pursuant to subdivision (1) of this subsection, a product testing 6
5959 facility shall use a traditional animal test method using the fewest animals 7
6060 possible and taking precautions to reduce animal pain and stress. 8
6161 (3) Nothing in this section shall: 9
6262 (A) apply to any animal testing conducted for the purpose of 10
6363 biomedical research; 11
6464 (B) prohibit the use of any nonanimal test method or strategy for the 12
6565 testing of any chemical, ingredient, drug, vaccine, product formulation, or 13
6666 product, even if not an alternative test method or strategy; 14
6767 (C) prohibit the use of a traditional animal test method as required by 15
6868 State or federal law; or 16
6969 (D) prohibit the use of a traditional animal test method that complies 17
7070 with a written request from a State or federal agency when the agency has 18
7171 approved an alternative test method or strategy but also has expressly 19
7272 concluded that a traditional animal test method is needed to fully assess the 20

8080 of each year, all product testing facilities 1
8181 operating in the State shall submit a report to the Office of the Attorney 2
8282 General regarding any animal testing conducted under this section during the 3
8383 previous calendar year. Each report shall include the number and species of 4
8484 animal used for traditional animal test methods, the type and number of 5
8585 alternative test methods used, the number of waivers used, and the purpose of 6
8686 any traditional animal test methods, alternative test methods, and waivers. The 7
8787 Office of the Attorney General shall publish on its website the results of data 8
8888 collected from submitted reports within 90 days following receipt. 9
8989 (d)(1) A violation of this section is deemed to be a violation of 10
9090 9 V.S.A. § 2453. 11
9191 (2) The Attorney General has the same authority to make rules, conduct 12
9292 civil investigations, enter into assurances of discontinuance, and bring civil 13
9393 actions, and private parties have the same rights and remedies, as provided 14
9494 under 9 V.S.A. chapter 63, subchapter 1. 15
9595 Sec. 2 EFFECTIVE DATE 16
9696 This act shall take effect on July 1, 2026. 17
