leadershipofworkforceeducationandemploymentandtrainingactivitiesin
Vermont.
AnactrelatingtoworkforceleadershipinVermont
ItisherebyenactedbytheGeneralAssemblyoftheStateofVermont:
Sec.1.10V.S.A.§ 540isamendedtoread:
§540.WORKFORCE EDUCATIONANDEMPLOYMENT AND
TRAININGLEADERLEADERS
(a)TheCommissionerofLaborandtheExecutiveDirectoroftheOfficeof
WorkforceStrategyandDevelopmentshallbetheleaderleadersofworkforce
educationandemploymentandtrainingintheState,andshallhavethe

authorityandresponsibilityforthecoordinationofworkforceeducationand
trainingwithinStategovernment,includingthefollowingduties:theState’s
workforcesystemasprovidedinthissection.
(b)Thepowersanddutiesprovidedinthissectionshallnotlimit,restrict,
orsuspendanysimilarpowerstheCommissionerofLaborortheExecutive
DirectoroftheOfficeofWorkforceStrategyandDevelopmentmayhave
underotherprovisionsoflaw.
(c)ForpurposesofthefederalWorkforceInnovationandOpportunityAct
(WIOA),theDepartmentofLaborshallbedesignatedastheStateWorkforce
AgencyandtheCommissionerofLaborshallserveastheStateWorkforce
Administrator.
(d)Asco-leaderofworkforceeducationandemploymentandtrainingin
theState,theCommissionerofLabor,inconsultationwiththeExecutive
DirectoroftheOfficeofWorkforceStrategyandDevelopmentwhere
appropriate,shall:
(1)PerformthefollowingdutiesinconsultationwiththeState
WorkforceDevelopmentBoard:ensurethecoordinationandadministrationof
workforceeducationandemploymentandtrainingprogramsoperatedbythe
DepartmentofLabor;
(A)advisetheGovernorontheestablishmentofanintegratedsystem
ofworkforceeducationandtrainingforVermont;

(B)createandmaintainaninventoryofallexistingworkforce
educationandtrainingprogramsandactivitiesintheState;
(C)usedatatoensurethatStateworkforceeducationandtraining
activitiesarealignedwiththeneedsoftheavailableworkforce,thecurrentand
futurejobopportunitiesintheState,andthespecificcredentialsneededto
achieveemploymentinthosejobs;
(D)developaStateplan,asrequiredbyfederallaw,toensurethat
workforceeducationandtrainingprogramsandactivitiesintheStateserve
Vermontcitizensandbusinessestothemaximumextentpossible;
(E)ensurecoordinationandnonduplicationofworkforceeducation
andtrainingactivities;
(F)identifybestpracticesandgapsinthedeliveryofworkforce
educationandtrainingprograms;
(G)designandimplementcriteriaandperformancemeasuresfor
workforceeducationandtrainingactivities;
(H)establishgoalsfortheintegratedworkforceeducationand
trainingsystem;and
(I)withtheassistanceoftheSecretariesofCommerceand
CommunityDevelopment,ofHumanServices,ofEducation,ofAgriculture,
FoodandMarkets,andofTransportationandoftheCommissionerofPublic

Safety,developandimplementacoordinatedsystemtorecruit,relocate,and
trainworkerstoensurethelaborforceneedsofVermont’sbusinessesaremet.
(2)Requirefromeachbusiness,trainingprovider,orprogramthat
receivesStatefundingtoconductworkforceeducationandtrainingareport
thatevaluatestheresultsofthetraining.Eachrecipientshallsubmititsreport
onascheduledeterminedbytheCommissionerandshallincludeatleastthe
followinginformation:enterintoagreements,totheextentnecessary,with
otherStateagenciesanddepartmentsforservicestoimprovetheemployment
andeconomicoutcomesforindividualsreceivingpublicassistance,including
agreementstoprovidecustomizedorspecializedservicesthatarebeyondthe
basicservicesrequiredbyfederallaw;
(A)nameofthepersonwhoreceivesfunding;
(B)amountoffunding;
(C)activitiesandtrainingprovided;
(D)numberoftraineesandtheirgeneraldescription;
(E)employmentstatusoftrainees;and
(F)futureneedsforresources.
(3)Reviewreportssubmittedbyeachrecipientofworkforceeducation
andtrainingfunding.developstrategiesandprovidesupporttoentities
responsibleforfederalinvestmentsintheState’sworkforcesystem;

(4)(A)IssueanannualreporttotheGovernor,theHouseCommitteeson
AppropriationsandonCommerceandEconomicDevelopment,andtheSenate
CommitteesonAppropriationsandonEconomicDevelopment,Housingand
GeneralAffairsonorbeforeDecember1thatincludesasystematicevaluation
oftheaccomplishmentsoftheStateworkforceinvestmentsystemandthe
performanceofparticipatingagenciesandinstitutions.Theprovisionsof2
V.S.A.§20(d)(expirationofrequiredreports)shallnotapplytothereportto
bemadeunderthissubdivision.developstrategiesdesignedtoreduce
employeelayoffsandbusinessclosures;and
(B)providereemploymentservicestoemployeesaffectedbylayoffs
andclosures;
(5)Coordinatepublicandprivateworkforceprogramstoensurethat
informationiseasilyaccessibletostudents,employees,andemployers,and
thatallinformationandnecessarycounselingisavailablethroughonecontact.

individualsandbusinessesthroughbothphysicalandvirtualservicedelivery
methods;
(6)Facilitateeffectivecommunicationbetweenthebusinesscommunity

(7)maintainafreeandsecureelectronicjobboardthat,totheextent
practicable,compilesallavailablejob,registeredapprenticeship,educationand
training,andcredentialingopportunitiesthatsupportjobseekersandcareer
advancers;
(7)(8)NotwithstandinganyprovisionofStatelawtothecontrary,andto
thefullestextentallowedunderfederallaw,ensurethatineachStateand
State-fundedworkforceeducationandtrainingprogram,theprogram
administratorcollectsandreportsdataandresultsattheindividuallevelby
SocialSecuritynumberoranequivalent.usedatatoensurethatState
workforceeducationandemploymentandtrainingactivitiesarealignedwith
theneedsofthe:
(A)availableworkforce;
(B)employerstofilltheircurrentandfuturejobopenings;and
(C)specificcredentialsrequiredbyemployers;
(8)(9)Coordinateintentionaloutreachandconnectionsbetweenstudents
graduatingfromVermont’scollegesanduniversitiesandemployment
opportunitiesinVermont.requirethateachbusiness,trainingprovider,orother
entityreceivingStatefundingtoconductworkforcetrainingsubmitareport
thatevaluatestheresultsofthetraining;and
(10)notwithstandinganyprovisionofStatelawtothecontrary,andto
thefullestextentallowedunderfederallaw,ensurethattheprogram

administratorineachStateandState-fundedworkforceeducationand
employmentandtrainingprogramcollectsandreportsdataandresultsatthe
individuallevelbySocialSecuritynumberorequivalent.
(e)Asco-leaderofworkforceeducationandemploymentandtrainingin
theState,theExecutiveDirectoroftheOfficeofWorkforceStrategyand
Development,inconsultationwiththeCommissionerofLaborandtheState
WorkforceDevelopmentBoardwhereappropriate,shall:
(1)advisetheGovernorandmembersoftheGovernor’scabinetonthe
establishmentandmanagementofanintegratedsystemofworkforceeducation
andtraininginVermont;
(2)coordinateacrosspublicandprivatesectorstoidentifyandaddress
laborforceneedsandensurethatworkforcedevelopmentprograminformation
iseasilyaccessibletostudents,employees,andbusinesses;
(3)developacomprehensiveworkforcestrategythatcontains
measurablestatewideworkforcegoalsalongwithabiennialoperationalplanto
achievethosegoalsthatshall:
(A)bedevelopedincollaborationwith,andrepresentativeof,
workforcesystempartners,includingpublic,private,nonprofit,and
educationalsectorsandtheStateWorkforceDevelopmentBoard;
(B)includeasetofmetrics,designedinconsultationwiththe
AgencyofAdministration’sChiefPerformanceOffice,usedtoevaluatethe

effectivenessof,totheextentpracticable,allworkforcedevelopment
programs;
(C)alignwithandbuilduponotherrequiredstrategicplanning
efforts,includingtheWIOAStatePlan;
(D)beinformedbytheinventorysystemassetforthinsubdivision
(4)ofthissubsection(e);and
(E)bereviewedandupdatedasnecessary,butatleastonceeverytwo
years;
(4)create,maintain,andupdateapubliclyaccessibleinventoryofall
knownworkforceeducationandemploymentandtrainingprogramsand
activitiesintheStateinorderto:
(A)annuallyassesstheinvestmentsandeffectivenessofthe
workforcedevelopmentsystem;
(B)ensurecoordinationandnonduplicationofworkforceeducation
andemploymentandtrainingactivities;and
(C)identifybestpracticesandgapsinthedeliveryofworkforce
educationandemploymentandtrainingprograms;
(5)identifyandmanagepriorityprojectsspecifictoregionalworkforce
needs;

(6)facilitateeffectivecommunicationbetweenthebusinesscommunity,
Stateandlocalgovernment,andpublicandprivateeducationalinstitutions,for
thepurposeofworkforcepipelinedevelopmentandjobplacement;
(7)coordinateintentionaloutreachandconnectionsbetweenstudents
andemploymentopportunitiesintheState;and
(8)ensuretheStateWorkforceDevelopmentBoardiscarryingoutits
dutiesandresponsibilitiesassetforthinsection541aofthischapter.
(f)(1)TheExecutiveDirectoroftheOfficeofWorkforceStrategyand
Developmentshall,onceeverytwoyears,issueacomprehensivebiennial
workforcereporttotheGovernor,theHouseCommitteesonAppropriations
andonCommerceandEconomicDevelopment,andtheSenateCommitteeson
AppropriationsandonEconomicDevelopment,HousingandGeneralAffairs,
onorbeforeDecember1,thatincludesanevaluationoftheaccomplishments
oftheStateworkforceinvestmentsystemandtheperformanceofparticipating
agenciesandinstitutionscoveringtheprevioustwocalendaryears.Thereport
shallincludeidentificationofsystempriorities,needforfuturefunding
requests,identificationofproposedlegislativeandadministrativechanges,and
anyotherinformationrelevanttotheperformanceandfutureneedsofthe
workforceinvestmentsystem.Thereportshallsummarizeperformanceand
outcomeinformationsubmittedbyfederallyandState-fundedworkforce
developmentandinvestmentprogramsforallpublicandnonpublicprograms.

(2)Totheextentpracticable,workforcereportsrequiredofthe
DepartmentofLabor,includingtheapprenticeshipreportrequiredby21
V.S.A.§ 1113(e)(2),shallbeincorporatedintothecomprehensivereport
requiredbysubdivision(1)ofthissubsection.
(3)TheExecutiveDirectoroftheOfficeofWorkforceStrategyand
DevelopmentshallhavethesupportandcoordinationoftheDepartmentof
Laborindevelopingandsubmittingthebiennialreportrequiredbysubdivision
(1)ofthissubsection.
(4)Theprovisionsof2V.S.A.§20(d)(expirationofrequiredreports)
shallnotapplytothereporttobemadeundersubdivision(1)ofthis
subsection.
Sec.2.EFFECTIVEDATE
ThisactshalltakeeffectonJuly1,2025.
