1111 Statement of purpose of bill as introduced: This bill proposes to require the 6
1212 seller of real property served by a wastewater system to provide the buyer with 7
1313 a certificate of inspection issued within two years prior to the conveyance. 8

1515 It is hereby enacted by the General Assembly of the State of Vermont: 10
1616 Sec. 1. 10 V.S.A. § 1973 is amended to read: 11
1717 § 1973. PERMITS 12
1818 (a) Except as provided in this section and sections 1974 and 1978 of this 13
1919 title, a person shall obtain a permit from the Secretary before: 14

2121 (3) constructing, replacing, or modifying a potable water supply or 16
2222 wastewater system; 17

2424 (e) No permit issued by the Secretary shall be valid for a substantially 19

3030 receives a statement from an installer or a licensed designer certifying that, in 1
3131 the exercise of his or her the installer’s or licensed designer’s reasonable 2
3232 professional judgment, the installation-related information submitted is true 3
3333 and correct and the potable water supply and wastewater system: 4
3434 (1) were installed in accordance with: 5
3535 (A) the permitted design and all permit conditions; or 6
3636 (B) record drawings and such record drawings are in compliance with 7
3737 the applicable rules, were filed with the Secretary, and are in accordance with 8
3838 all other permit conditions; 9
3939 (2) were inspected; 10
4040 (3) were properly tested; and 11
4141 (4) have successfully met those performance tests. 12

4343 (h) All permits required under this section, all design and installation 14
4444 certifications required under this section, all inspection certifications required 15
4545 under this section, and all documents required by the rules adopted under this 16
4646 chapter to be filed in the town records shall be properly indexed and recorded 17
4747 in the land records pursuant to 24 V.S.A. §§ 1154 and 1161. 18

4949 (k) Prior to conveyance of real property served by a wastewater system, the 20

5555 the wastewater system conducted within two years prior to the conveyance. 1
5656 An inspection shall be conducted by a licensed designer who shall certify the 2
5757 functionality of the wastewater system, evaluate the system for compliance 3
5858 with the requirements of this chapter and rules adopted under this chapter, and 4
5959 identify any maintenance or repair needs for the system. The licensed designer 5
6060 shall file a certificate of inspection with the Secretary and shall file a copy of 6
6161 the certificate of inspection in the lands records of the town where the 7
6262 wastewater system is located. 8
6363 Sec. 2. EFFECTIVE DATE 9
6464 This act shall take effect on July 1, 2025. 10
