2828 It is hereby enacted by the General Assembly of the State of Vermont: 1
2929 Sec. 1. 13 V.S.A. § 4019a is amended to read: 2
3030 § 4019a. FIREARMS TRANSFERS; WAITING PERIOD 3
3131 (a) A person shall not transfer a firearm to another person until 72 hours 4
3232 after the licensed dealer facilitating the transfer is provided with a unique 5
3333 identification number for the transfer by the National Instant Criminal 6
3434 Background Check System (NICS) or seven business days have elapsed since 7
3535 the dealer contacted NICS to initiate the background check, whichever occurs 8
3636 first. 9
3737 (b) A person who transfers a firearm to another person in violation of 10
3838 subsection (a) of this section shall be imprisoned not more than one year or 11
3939 fined not more than $500.00, or both. 12
4040 (c) This section shall not apply to a firearm transfer that does not require a 13
4141 background check under 18 U.S.C. § 922(t) or section 4019 of this title. 14
4242 (d) As used in this section, “firearm” has the same meaning as in 15
4343 subsection 4017(d) of this title. 16
4444 (e) [Repealed.] 17
4545 (f) This section shall not apply to the return of a firearm, frame, or receiver 18
4646 to a person by a licensed dealer after the dealer has serialized it pursuant to 19
4747 federal law or section 4084 of this title if the dealer returns the firearm, frame, 20

5353 (g)(1) This section shall not apply to a firearms transfer at a gun show. 1
5454 (2) As used in this subsection, “gun show” means a function sponsored 2
5555 by: 3
5656 (A) a national, state, or local organization, devoted to the collection, 4
5757 competitive use, or other sporting use of firearms; or 5
5858 (B) an organization or association that sponsors functions devoted to 6
5959 the collection, competitive use, or other sporting use of firearms in the 7
6060 community. 8
6161 Sec. 2. EFFECTIVE DATE 9
6262 This act shall take effect on passage. 10
