Statement of purpose of bill as introduced:  This bill proposes to create a date 9 
certain for the Department of Corrections to implement its community 10 
restitution program (work crew), as well as mandating the reinstitution of prior 11 
policies governing the program and limitations on the time periods imposed for 12 
work crew. 13 
An act relating to developing the Department of Corrections’ community 14 
restitution program 15 
It is hereby enacted by the General Assembly of the State of Vermont:  16 
Sec. 1.  COMMUNITY RESTITUTION; DEVELOPMENT; 17 
             IMPLEMENTATION 18 
(a)  On or before July 1, 2025, the Department of Corrections shall 19 
reinstitute the Field Based Community Restitution Program, commonly 20  BILL AS INTRODUCED 	H.176

referred to as “work crew,” that was discontinued by the Rescinding 1 
Memorandum issued by the Department, which rescinded Department Policy 2 
#339.01, Court and Reparative Services Unit Operations Directive, dated 3 
March 13, 1995 and Department Policy #392.01, Operation of Field Based 4 
Community Restitution Program, dated July 1, 2021, and was effective on July 5 
1, 2023. 6 
(b)  The Department of Corrections may enact policies limiting the number 7 
of days ordered on a single mittimus and how many total work crew days an 8 
offender may have outstanding at any time to be eligible for work crew.  The 9 
Department shall set the number of work crew days imposed under a single 10 
mittimus to not less than 20 days or the total number that may be outstanding 11 
on multiple mittimuses to not less than 60 days. 12 
Sec. 2.  EFFECTIVE DATE 13 
This act shall take effect on passage. 14
