1212 Statement of purpose of bill as introduced: This bill proposes to allow 7

1515 It is hereby enacted by the General Assembly of the State of Vermont: 10
1616 Sec. 1. 3 V.S.A. § 1011 is amended to read: 11
1717 § 1011. DEFINITIONS 12
1818 As used in this chapter: 13

2020 (8) “Employee,” “Employee” means any individual employed and 15
2121 compensated on a permanent or limited status basis by the Judiciary 16
2222 Department, including permanent part-time employees and any individual 17
2323 whose employment has ceased as a consequence of, or in connection with, any 18
2424 current labor dispute or because of an unfair labor practice. “Employee” does 19

3030 (A) a Justice, judge, assistant judge, magistrate, or hearing officer; 1
3131 (B) the Court Administrator; 2
3232 (C) a managerial, supervisory, or confidential employee; 3
3333 (D) a law clerk, attorney, or administrative assistant or private 4
3434 secretary to a judge, Justice, or Court Administrator; 5
3535 (E) an individual employed on a temporary, contractual, seasonal, or 6
3636 on-call basis, including an intern; 7
3737 (F) an employee during the initial or extended probationary period; 8
3838 (G) the head of a department or division; 9
3939 (H) [Repealed.] 10
4040 (I) an attorney for the Supreme Court, for the Court Administrator, or 11
4141 for any board or commission created by the Supreme Court; 12
4242 (J) an employee paid by the State who is appointed part-time as 13
4343 county clerk pursuant to 4 V.S.A. § 651 or 691; or 14
4444 (K) an employee who, after hearing by the Board upon petition of 15
4545 any individual, the employer, or a collective bargaining unit, is determined to 16
4646 be in a position that is sufficiently inconsistent with the spirit and intent of this 17
4747 chapter to warrant exclusion. 18
