1212 Statement of purpose of bill as introduced: This bill proposes to require the 7
1313 Secretary of Natural Resources to amend the Department of Environmental 8
1414 Conservation’s Water Supply Rule to establish a maximum contaminant level 9
1515 (MCL) of zero parts per trillion for the perfluoroalkyl and polyfluoroalkyl 10
1616 substances (PFAS) of perfluorooctanoic acid, perfluorooctane sulfonic acid, 11
1717 perfluorohexane sulfonic acid, perfluorononanoic acid, perfluoroheptanoic 12
1818 acid, and perfluorodecanoic acid. The bill also would propose that the 13
1919 Secretary of Natural Resources amend the Department of Environmental 14
2020 Conservation’s Water Supply Rule to establish an MCL of not more than 20 15
2121 parts per trillion for any testable PFAS other than those specifically required to 16

2929 It is hereby enacted by the General Assembly of the State of Vermont: 3
3030 Sec. 1. DEPARTMENT OF ENVIRONMENTAL CONSERVATION; 4
3131 DRINKING WATER STANDARDS; PERFLUOROALKYL AND 5
3232 POLYFLUOROALKYL SUBSTANCES 6
3333 (a) As used in this section, “perfluoroalkyl and polyfluoroalkyl substances” 7
3434 or “PFAS” means a class of fluorinated organic chemicals containing at least 8
3535 one fully fluorinated carbon atom. 9
3636 (b) On or before July 1, 2026, the Secretary of Natural Resources shall file 10
3737 under 3 V.S.A. § 841 a final proposed rule with the Secretary of State and the 11
3838 Legislative Committee on Administrative Rules establishing the following 12
3939 under the Department of Environmental Conservation’s Water Supply Rule: 13
4040 (1) a maximum contaminant level (MCL) of zero parts per trillion for 14
4141 the PFAS of perfluorooctanoic acid, perfluorooctane sulfonic acid, 15
4242 perfluorohexane sulfonic acid, perfluorononanoic acid, perfluoroheptanoic 16
4343 acid, and perfluorodecanoic acid; and 17
4444 (2) an MCL of not more than 20 parts per trillion total for any testable 18
4545 PFAS combined other than those PFAS listed under subdivision (1) of this 19
4646 subsection. 20
4747 Sec. 2. EFFECTIVE DATE 21
4848 This act shall take effect on July 1, 2025. 22
