33 | 33 | | (a) As used in this section, “perfluoroalkyl and polyfluoroalkyl substances” 7 |

34 | 34 | | or “PFAS” means a class of fluorinated organic chemicals containing at least 8 |

35 | 35 | | one fully fluorinated carbon atom. 9 |

36 | 36 | | (b) On or before July 1, 2026, the Secretary of Natural Resources shall file 10 |

37 | 37 | | under 3 V.S.A. § 841 a final proposed rule with the Secretary of State and the 11 |

38 | 38 | | Legislative Committee on Administrative Rules establishing the following 12 |
---|
39 | 39 | | under the Department of Environmental Conservation’s Water Supply Rule: 13 |
---|
40 | 40 | | (1) a maximum contaminant level (MCL) of zero parts per trillion for 14 |
---|
41 | 41 | | the PFAS of perfluorooctanoic acid, perfluorooctane sulfonic acid, 15 |
---|
42 | 42 | | perfluorohexane sulfonic acid, perfluorononanoic acid, perfluoroheptanoic 16 |
---|
43 | 43 | | acid, and perfluorodecanoic acid; and 17 |
---|
44 | 44 | | (2) an MCL of not more than 20 parts per trillion total for any testable 18 |
---|
45 | 45 | | PFAS combined other than those PFAS listed under subdivision (1) of this 19 |
