1616 Statement of purpose of bill as introduced: This bill proposes to require 11
1717 employers and subcontractors working on State construction projects to 12
1818 maintain accurate payroll records, to preserve the records for three years, and 13
1919 to open the records for inspection by the Commissioner of Labor or the 14
2020 Attorney General. This bill also proposes that the payroll records be subject to 15
2121 public inspection and copying under the Vermont Public Records Act. 16

2323 It is hereby enacted by the General Assembly of the State of Vermont: 18
2424 Sec. 1. 29 V.S.A. § 161 is amended to read: 19

3131 (d) Subsections (a) through (c) and subsection (g) of this section shall not 2
3232 apply to maintenance or construction projects carried out by the Agency of 3
3333 Transportation and by the Department of Forests, Parks and Recreation. 4

3535 (g) Employers and subcontractors contracting with the State of Vermont 6
3636 pursuant to this section shall keep a true and accurate record of all employees 7
3737 working on the project. 8
3838 (1) For each employee, the record shall include: 9
3939 (A) the name of the employee; 10
4040 (B) the address of the employee; 11
4141 (C) the hours worked by the employee; 12
4242 (D) the wages paid to the employee; 13
4343 (E) the employee’s rate of pay; and 14
4444 (F) the classification of the employee; the licensed trades shall supply 15
4545 proof of classification of journey workers and indentured apprentices. 16
4646 (2) The records described in subdivision (1) of this subsection shall be 17
4747 submitted weekly by U.S. mail or electronic mail to the State agency 18
4848 overseeing the construction project. The records shall be accompanied by a 19
4949 signed statement from the employer or subcontractor verifying the accuracy of 20

5555 (3) Each employer and subcontractor shall preserve the records 1
5656 described in subdivision (1) of this section for three years from the date of 2
5757 completion of the State project. The records shall be available for inspection 3
5858 by the Commissioner of Labor or the Attorney General at any reasonable time 4
5959 upon request. 5
6060 (4) The records received pursuant to subdivision (2) of this section shall 6
6161 be subject to inspection or copying pursuant to 1 V.S.A. §§ 315–320. 7
