BILL AS INTRODUCED H.345 2025 Page 1 of 3 VT LEG #380463 v.1 H.345 1 Introduced by Representative O’Brien of Tunbridge 2 Referred to Committee on 3 Date: 4 Subject: Conservation and development; solid waste; single use plastics; glitter 5 Statement of purpose of bill as introduced: This bill proposes to prohibit the 6 sale, offer for sale, or distribution into the commerce of the State of any glitter 7 containing intentionally added synthetic polymer microparticles. 8 An act relating to prohibiting the sale or distribution of glitter containing 9 intentionally added synthetic polymers 10 It is hereby enacted by the General Assembly of the State of Vermont: 11 Sec. 1. 10 V.S.A. § 6701 is added to read: 12 § 6701. GLITTER CONTAINING SYNTHETIC POLYMERS 13 (a) As used in this section: 14 (1) “Glitter” means an assortment of flat, small, reflective particles that 15 are precision cut and come in a variety of shapes, sizes, and colors used for 16 decoration or ornamentation. 17 (2) “Intentionally added synthetic polymer microparticles” mean 18 synthetic polymer microplastics that a manufacturer has added to a product to 19 BILL AS INTRODUCED H.345 2025 Page 2 of 3 VT LEG #380463 v.1 confer a sought-after characteristic, in mixtures in a concentration equal to or 1 greater than one one-hundredth percent (0.01%) by weight. 2 (3)(A) “Synthetic polymer microparticles” mean polymers that are solid 3 and that fulfill both of the following conditions: 4 (i) the polymers are contained in particles and constitute at least 5 one percent by weight of those particles or build a continuous surface coating 6 on particles; and 7 (ii) at least one percent by weight of the particles fulfill either of 8 the following conditions: 9 (I) all dimensions of the particles are equal to or less than five 10 millimeters in size; or 11 (II) the length of the particles is equal to or less than 15 12 millimeters and each particle’s length is greater than three times the diameter. 13 (B) “Synthetic polymer microparticles” does not include polymers that 14 are the result of a polymerization process that has taken place in nature and not 15 as a result of human intervention, independently of the process through which 16 they have been extracted, which are not chemically modified substances. 17 (b)(1) Beginning on January 1, 2028, a person shall not sell, offer for sale, 18 or distribute into the commerce of the State any glitter containing intentionally 19 added synthetic polymer microparticles. 20 BILL AS INTRODUCED H.345 2025 Page 3 of 3 VT LEG #380463 v.1 (2) The prohibition under subdivision (1) of this subsection shall not 1 apply to glitter that is biodegradable, soluble, or natural and that does not 2 contain synthetic polymer microparticles. 3 Sec. 2. EFFECTIVE DATE 4 This act shall take effect on July 1, 2025. 5
