1111 Statement of purpose of bill as introduced: This bill proposes to provide that it 6
1212 is the State policy to encourage the procurement of local foods by State 7
1313 institutions and State universities and colleges to increase the viability of 8
1414 Vermont farms and food businesses. The bill would provide that a State 9
1515 institution or a State university or college purchasing food shall provide a 10
1616 preference to local foods when local foods are comparable in costs to foods 11
1717 that have not been grown or produced in the State. The bill would require a 12
1818 person responsible for procuring food or other items on behalf of a State 13
1919 institution or a State university or college to purchase local foods unless the 14
2020 price of local goods exceeds by more than 10 percent the price of food or other 15
2121 agricultural products grown or produced that were not grown or produced 16
2222 within Vermont. 17

2828 It is hereby enacted by the General Assembly of the State of Vermont: 1
2929 Sec. 1. FINDINGS 2
3030 The General Assembly finds that: 3
3131 (1) Vermont recognizes the importance of local production and supply 4
3232 as a means to empower communities, strengthen local economies, and ensure 5
3333 access to healthy, locally produced foods; 6
3434 (2) institutional purchasing from Vermont farms can significantly 7
3535 bolster the State’s agricultural sector, support sustainable farming practices, 8
3636 and promote economic resilience; and 9
3737 (3) the State should support Vermont farms and the farming economy by 10
3838 giving preference to local foods in the purchasing by State agencies, State 11
3939 universities, and State colleges. 12

4242 § 941. DEFINITIONS 15
4343 As used in this subchapter: 16
4444 (1) “Local food” has the same meaning as “local,” “local to Vermont,” 17
4545 and “locally grown or made in Vermont” as in 9 V.S.A. § 2465a. 18
4646 (2) “State agency” means any Executive Branch agency, department, or 19
4747 entity created by Title 3 of the Vermont Statutes Annotated and any board, 20 BILL AS INTRODUCED H.408

5252 commission, council, or similar entity attached to an Executive Branch agency, 1
5353 department, or entity. 2
5454 (3) “State universities and colleges” means the University of Vermont 3
5555 and the Vermont State Colleges. 4
5656 (4) “State institution” means any State agency, any office of the State 5
5757 judiciary, and any office of the General Assembly. 6
5858 § 942. STATE POLICY 7
5959 It is the policy of the State to encourage the procurement of local foods by 8
6060 State institutions and State universities and colleges to increase the viability of 9
6161 Vermont farms and food businesses, thus making a positive contribution to the 10
6262 State’s economy and enhancing food self-sufficiency for Vermont. 11
6363 § 943. PREFERENCE FOR LOCAL FOOD 12
6464 (a) Notwithstanding any law to the contrary, and to the extent permitted by 13
6565 federal law, a State institution or a State university or college purchasing food 14
6666 shall provide a preference to local foods when local foods are comparable in 15
6767 costs to foods that have not been grown or produced in the State. 16
6868 (b) The person responsible for procuring food or other items on behalf of a 17
6969 State institution or a State university or college shall purchase local foods 18
7070 unless the price of local goods exceeds by more than 10 percent the price of 19
7171 food or other agricultural products grown or produced that were not grown or 20

7878 § 1266. FOOD SERVICE MANAGEMENT COMPAN Y BIDS 2
7979 When a food service management company or other food supplier submits a 3
8080 bid to a supervisory union, supervisory district, school board, or school in 4
8181 response to a request for a proposal or bid solicitation to supply a school 5
8282 nutrition program, the food service management company or food supplier 6
8383 shall include in their bid information related to how the food service 7
8484 management company or food supplier can supply a supervisory union, 8
8585 supervisory district, school board, or school with locally produced foods that 9
8686 would allow the supervisory union, supervisory district, school board, or 10
8787 school to qualify for a local foods incentive grant under section 1264a of this 11
8888 title. 12
8989 Sec. 4. EFFECTIVE DATE 13
9090 This act shall take effect on July 1, 2025. 14
