Statementofpurposeofbillasintroduced:Thisbillproposestorequirethe
GovernortogetapprovaloftheGeneralAssemblybeforeenteringintocertain
immigrationagreements.
Anactrelatingtorequiringlegislativeapprovalpriortoenteringinto
certainimmigrationagreements
Anactrelatingtoauthorizationtoenterintocertainimmigration

ItisherebyenactedbytheGeneralAssemblyoftheStateofVermont:
Sec.1.20V.S.A.§ 4652isamendedtoread:
§4652.AUTHORIZATIONTOENTERINTOAGREEMENTS
PURSUANTTO8U.S.C.§1357(g)AND19U.S.C.§1401(i)
(a)Notwithstandinganyotherprovisionoflaw,onlytheGovernor,in
consultationwiththeVermontAttorneyGeneraluponapprovalfromthe
GeneralAssemblyassetforthinsubsection(b)ofthissection,isauthorizedto

enterinto,modify,orextendanagreementpursuantto8U.S.C.§1357(g)or
19U.S.C.§1401(i).
(b)Notwithstandingsubsection(a)ofthissection,aState,county,or
municipallawenforcementagencyisauthorizedtoenterintoanagreement
pursuantto8U.S.C.§1357(g)or19U.S.C.§1401(i)whennecessaryto
addressthreatstothepublicsafetyorwelfareofVermontresidentsarisingout
ofadeclarationofaStateornationalemergency
(1)TheGovernorshallnotenterintoanagreementpursuantto8U.S.C.
§1357(g)or19U.S.C.§1401(i)withoutpriorapprovalfromtheGeneral
Assembly.
(2)Notfewerthan60daysbeforetheGeneralAssemblymayvoteona
proposedagreementpursuanttosubdivision(1)ofthissubsection,the
Governorshall:
(A)providetheGeneralAssemblywith:
(i)thefulltextoftheproposedagreement;and
(ii)ananalysisofthepotentialfiscal,social,andlegalimpactsof
theagreement;and
(B)holdoneormorepublichearingsinordertoinformandgather
inputfromVermonters,includingimmigrantadvocacyorganizations,onthe
proposedagreement.

(3)Noagreementpursuantto8U.S.C.§1357(g)or19U.S.C.§1401(i)
shallbeenteredintoiftheGeneralAssemblyisnotinsession.
(4)NoState,county,ormunicipallawenforcementagencyorofficer
shallengageinanydutyoractionpursuanttoan8U.S.C.§1357(g)or
19 U.S.C.§1401(i)agreementunlesstheGeneralAssemblyapprovesofsuch
agreementassetforthinsubdivision(1)ofthissubsection.
(c)OnorbeforeDecember1ofeachyear,theGovernorshallsubmita
lettertotheHouseCommitteeonGovernmentOperationsandMilitaryAffairs
andtheSenateCommitteeonGovernmentOperationsaddressingthe
followingmatters:
(1)providingdetailsonanyinformalandformaldiscussionsand
negotiationsinvolvingagreementspursuantto8U.S.C.§1357(g)or19U.S.C.
§1401(i);and
(2)confirmingthatnoagreementpursuantto8U.S.C.§1357(g)or
19 U.S.C.§1401(i)hasbeenenteredintowithoutapprovalfromtheGeneral
Assembly.
Sec.2.EFFECTIVEDATE
Thisactshalltakeeffectonpassage.
Sec.1.20V.S.A.§ 4652isamendedtoread:

(b)Notwithstandingsubsection(a)ofthissection,aState,county,or
municipallawenforcementagencyisauthorizedtoenterintoanagreement
pursuantto8U.S.C.§1357(g)or19U.S.C.§1401(i)whennecessaryto
addressthreatstothepublicsafetyorwelfareofVermontresidentsarisingout
ofadeclarationofaStateornationalemergencyNopublicagency,asthat
termisdefinedin1V.S.A.§317,oranofficer,employee,agent,or
independentcontractorofapublicagency, shallenterintoanagreement
pursuantto8U.S.C.§1357(g)or19 U.S.C.§1401(i)unlesstheGovernorhas
authorizedtheagreementassetforthinsubsection(a)ofthissection.
Sec.2.EFFECTIVEDATE
Thisactshalltakeeffectonpassage.
