(b)Notwithstandingsubsection(a)ofthissection,aState,county,or municipallawenforcementagencyisauthorizedtoenterintoanagreement pursuantto8U.S.C.§1357(g)or19U.S.C.§1401(i)whennecessaryto addressthreatstothepublicsafetyorwelfareofVermontresidentsarisingout ofadeclarationofaStateornationalemergency (1)TheGovernorshallnotenterintoanagreementpursuantto8U.S.C. §1357(g)or19U.S.C.§1401(i)withoutpriorapprovalfromtheGeneral Assembly. (4)NoState,county,ormunicipallawenforcementagencyorofficer shallengageinanydutyoractionpursuanttoan8U.S.C.§1357(g)or 19 U.S.C.§1401(i)agreementunlesstheGeneralAssemblyapprovesofsuch agreementassetforthinsubdivision(1)ofthissubsection. (c)OnorbeforeDecember1ofeachyear,theGovernorshallsubmita lettertotheHouseCommitteeonGovernmentOperationsandMilitaryAffairs andtheSenateCommitteeonGovernmentOperationsaddressingthe followingmatters: (1)providingdetailsonanyinformalandformaldiscussionsand negotiationsinvolvingagreementspursuantto8U.S.C.§1357(g)or19U.S.C. §1401(i);and (2)confirmingthatnoagreementpursuantto8U.S.C.§1357(g)or 19 U.S.C.§1401(i)hasbeenenteredintowithoutapprovalfromtheGeneral Assembly. Sec.2.EFFECTIVEDATE Thisactshalltakeeffectonpassage. (b)Notwithstandingsubsection(a)ofthissection,aState,county,or municipallawenforcementagencyisauthorizedtoenterintoanagreement pursuantto8U.S.C.§1357(g)or19U.S.C.§1401(i)whennecessaryto addressthreatstothepublicsafetyorwelfareofVermontresidentsarisingout ofadeclarationofaStateornationalemergencyNopublicagency,asthat termisdefinedin1V.S.A.§317,oranofficer,employee,agent,or independentcontractorofapublicagency, shallenterintoanagreement pursuantto8U.S.C.§1357(g)or19 U.S.C.§1401(i)unlesstheGovernorhas authorizedtheagreementassetforthinsubsection(a)ofthissection. Sec.2.EFFECTIVEDATE Thisactshalltakeeffectonpassage.
