Statement of purpose of bill as introduced:  This bill proposes to prohibit 8 
Vermont from using California’s Clean Air Act waiver to set motor vehicle 9 
emission standards. 10 
An act relating to revoking Vermont’s use of California’s Clean Air Act 11 
waiver 12 
It is hereby enacted by the General Assembly of the State of Vermont:  13 
Sec. 1.  10 V.S.A. § 567 is amended to read: 14 
§ 567.  MOTOR VEHICLE POLLUTION 15 
(a)  The Secretary, in conjunction with the Department of Motor Vehicles, 16 
may provide rules for the control of emissions from motor vehicles.  However, 17 
the Secretary shall not adopt the California rules for new motor vehicles 18 
authorized in the Clean Air Act, 42 U.S.C. § 7507. Such The rules may 19

reduce or eliminate emissions and for the proper maintenance of the equipment 1 
and the vehicles.  Rules pursuant to this section shall be consistent with 2 
provisions of federal law, if any, relating to control of emissions from the 3 
vehicles concerned and shall not require, as a condition precedent to the initial 4 
sale of a vehicle or vehicular equipment, the inspection, certification, or other 5 
approval of any feature or equipment designed for the control of emissions 6 
from motor vehicles, if the feature or equipment has been certified, approved, 7 
or otherwise authorized pursuant to federal law. 8

Sec. 2.  10 V.S.A. § 558 is amended to read: 10 
§ 558.  EMISSION CONTROL REQUIREMENTS 11 
The Secretary may establish such emission control requirements, by rule, as 12 
in his or her the Secretary’s judgment may be necessary to prevent, abate, or 13 
control air pollution.  The requirements may be for the State as a whole or may 14 
vary from area to area, as may be appropriate to facilitate accomplishment of 15 
the purposes of this chapter, and in order to take necessary or desirable account 16 
of varying local conditions.  However, the Secretary shall not adopt the 17 
California rules for new motor vehicles authorized in the Clean Air Act, 18

Sec. 3.  10 V.S.A. § 592 is amended to read: 1 
§ 592.  THE VERMONT CLIMATE ACTION PLAN 2

(e)  The Plan shall form the basis for the rules adopted by the Secretary of 4 
Natural Resources pursuant to section 593 of this chapter.  If the Council fails 5 
to adopt the Plan or update the Plan as required by this chapter, the Secretary 6 
shall proceed with adopting and implementing rules pursuant to subsection 7 
593(j) of this chapter to achieve the greenhouse gas emissions reductions 8 
requirements pursuant to section 578 of this title. However, in neither instance 9 
shall the Secretary adopt the California rules for new motor vehicles authorized 10 
in the Clean Air Act, 42 U.S.C. § 7507. 11 
Sec. 4.  RULE REPEAL 12 
The Vermont Low Emission Vehicle and Zero Emission Vehicle Rules, 13 
Department of Environmental Conservation, Chapter 40:  Vermont Low 14 
Emission Vehicle and Zero Emission Vehicle Rules (CVR 12-30-40) are 15 
repealed. 16 
Sec. 5.  EFFECTIVE DATE 17 
This act shall take effect on July 1, 2025. 18
