(2)Notwithstandingtheprovisionsofsubdivision(1)ofthissubsection, anindividualoremployingunitwhoinanymannersucceedstooracquiresthe organization,trade,orbusinessorsubstantiallyalloftheassetsofany employingunitwhowasanemployerbeforethedateofacquisitionandwhose currentlyassignedcontributionrateishigherthanthatcurrentlyassignedtothe acquiringindividualoremployingunitshallnotbetreatedasasuccessor.
