Placardsshallbereturnedtotheorganizationwhenthevolunteerdriverisno longerperformingthatservice.Abuseoftheprivilegesprovidedbythe placardsmayresultintheprivilegesbeingrevokedandtheplacards repossessedbytheCommissioner.Revocationmayoccuronlyaftersuitable noticeandopportunityforahearing.Hearingsshallbeheldinaccordance withsections105–107ofthistitle. *** (e)(1)Anindividual,otherthananeligibleperson,whoforhisorherthe individual’sownpurposesparksavehicleinaspaceforindividualswith disabilitiesshallbesubjecttoacivilpenaltyofnotlessthan$200.00foreach violationandshallbeliablefortowingcharges. (b)Generalexemptions.Notwithstandingsubsection(a)ofthissection,a personanindividualmayoperateamotorvehiclewithmaterialoritems paintedoradheredonorover,orhunginbackof,thewindshield,vent windows,orsidewindows: (1)inaspacenotoverfourincheshighand12incheslonginthelower right-handcornerofthewindshield; 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 BILLASINTRODUCEDANDPASSEDBYSENATE S.123 2025 Page50of57 (2)insuchanyspaceastheCommissionerofMotorVehiclesmay specifyforlocationofanystickerrequiredbygovernmentalregulation; (3)inaspacenotovertwoincheshighandtwoandone-halfincheslong intheupperleft-handcornerofthewindshield; (4)iftheoperatorisapersonanindividualemployedbythefederal, State,orlocalgovernmentoravolunteeremergencyresponderoperatingan authorizedemergencyvehicle,whoplacesanynecessaryequipmentinbackof thewindshieldofthevehicle,providedtheequipmentdoesnotinterferewith theoperator’scontrolofthedrivingmechanismofthevehicle; (5)onamotorvehiclethatisforsalebyalicensedautomobiledealer priortothesaleofthevehicle,inaspacenotoverthreeincheshighandsix incheslongintheupperleft-handcornerofthewindshield,andinaspacenot overfourincheshighand18incheslongintheupperright-handcornerofthe windshield;or (6)iftheobjectisarearviewmirror,orisanelectronictoll-collection transponderlocatedeitherbetweentherooflineandtherearviewmirrorpost orbehindtherearviewmirror;or (7)iftheobjectisshadingortintingmaterialandthevisiblelight transmissionofthemotorvehiclewindshield,ventwindow,orsidewindow withthatshadingortintingmaterialisnotlessthan70percent. 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 BILLASINTRODUCEDANDPASSEDBYSENATE S.123 2025 Page51of57 (c)Medicalexemption.TheCommissionermaygrantanexemptiontothe prohibitionofthissectionuponapplicationfromapersonanindividual requiredformedicalreasonstobeshieldedfromtheraysofthesunandwho attachestotheapplicationadocumentsignedbyalicensedphysicianor optometristcertifyingthatshieldingfromtheraysofthesunisamedical necessity.Thephysicianoroptometristcertificationshallberenewedevery fouryears.However,whenalicensedphysicianoroptometristhaspreviously certifiedtotheCommissionerthatanapplicant’sconditionisbothpermanent andstable,theexemptionmayberenewedbytheapplicantwithoutsubmission ofaformsignedbyalicensedphysicianoroptometrist.Additionally,the windowshadingortintingpermittedunderthissubsectionshallbelimitedto theventwindowsorsidewindowslocatedimmediatelytotheleftandrightof theoperator.Theexemptionprovidedinthissubsectionshallterminateupon thetransferoftheapprovedvehicleandatthattimetheapplicablewindow tintingshallberemovedbytheseller.Furthermore,ifthematerialdescribed inthissubsectiontearsorbubblesorisotherwiseworntoprohibitclearvision, itshallberemovedorreplaced. (f)Definition.Asusedinthissection,“visiblelighttransmission”means theamountofvisiblelightthatcanpassthroughshading,tinting,orglazing materialappliedtoorwithinthetransparentportionofawindoworwindshield ofamotorvehicle. Sec.40.LEGISLATIVEINTENT;TINTEDWINDOWS ItistheintentoftheGeneralAssemblythatamotorvehiclewithshadingor tintingmaterialthatisnotallowedunder23V.S.A.§ 1125,asamendedby Sec.39ofthisact,posesadangertotheindividualoperatingthemotor vehicle,anypassengersinthemotorvehicle,andotherhighwayusersandthat suchamotorvehicleshallfailtheannualsafetyinspectionrequiredunder 23 V.S.A.§ 1222.
