(1)“Ambulatorydisability”meansanimpairmentthatpreventsor
impedeswalking.Anindividualshallbeconsideredtohaveanambulatory
disabilityifheorshetheindividual:

(F)isseverelylimitedinhisorhertheindividual’sabilitytowalk
duetoanarthritic,neurological,ororthopediccondition.

(b)Specialregistrationplatesorremovablewindshieldplacards,orboth,
shallbeissuedbytheCommissioner.Theplacardshallbeissuedwithoutafee
toanindividualwhoisblindorhasanambulatorydisability.Onesetofplates
shallbeissuedwithoutadditionalfeesforavehicleregisteredorleasedtoan
individualwhoisblindorhasanambulatorydisabilityortoaparentor
guardianofanindividualwithapermanentdisability.TheCommissioner
shallissuetheseplacardsorplatesunderrulesadoptedbyhimorherthe

registerednurse.TheCommissionershallfiletheformforfuturereference
andissuetheplacardorplate.Anewapplicationshallbesubmittedeveryfour
yearsinthecaseofplacardsandateverythirdregistrationrenewalforplates
butinnocasegreaterthaneveryfouryears.Whenalicensedphysician,
licensedphysicianassistant,orlicensedadvancedpracticeregisterednursehas
previouslycertifiedtotheCommissionerthatanapplicant’sconditionisboth
permanentandstable,aspecialregistrationplateorplacardneednotbe
renewed.

(3)Anindividualwithadisabilitywhoabusessuchprivilegesorallows
individualsnotdisabledtoabusetheprivilegesprovidedinthissectionmay
havethisprivilegerevokedaftersuitablenoticeandopportunityforhearing
hasbeengivenhimorhertheindividualbytheCommissioner.Hearings
undertheprovisionsofthissectionshallbeheldinaccordancewithsections
105–107ofthistitleandshallbesubjecttoreviewbytheCivilDivisionofthe
SuperiorCourtofthecountywheretheindividualwithadisabilityresides.
(4)Anapplicantforaregistrationplateorplacardforindividualswith
disabilitiesmayrequesttheCivilDivisionoftheSuperiorCourtinthecounty
inwhichheorshetheapplicantresidestoreviewadecisionbythe
Commissionertodenyhisorhertheapplicant’sapplicationforaspecial
registrationplateorplacard.

(6)OnaformprescribedbytheCommissioner,anonprofitorganization
thatprovidesvolunteerdriverstotransportindividualswhohavean
ambulatorydisabilityorareblindmayapplytotheCommissionerfora
placard.Placardsshallbemarked“volunteerdriver.”Theorganizationshall
ensureproperuseofplacardsandmaintainanaccurateandcompleterecordof
thevolunteerdriverstowhomtheplacardsaregivenbytheorganization.
Placardsshallbereturnedtotheorganizationwhenthevolunteerdriverisno
longerperformingthatservice.Abuseoftheprivilegesprovidedbythe
placardsmayresultintheprivilegesbeingrevokedandtheplacards
repossessedbytheCommissioner.Revocationmayoccuronlyaftersuitable
noticeandopportunityforahearing.Hearingsshallbeheldinaccordance
withsections105–107ofthistitle.

(e)(1)Anindividual,otherthananeligibleperson,whoforhisorherthe
individual’sownpurposesparksavehicleinaspaceforindividualswith
disabilitiesshallbesubjecttoacivilpenaltyofnotlessthan$200.00foreach
violationandshallbeliablefortowingcharges.
(2)Anindividual,otherthananeligibleperson,whodisplaysaspecial
registrationplateorremovablewindshieldplacardnotissuedtohimorherthe
individualunderthissectionandparksavehicleinaspaceforindividualswith

disabilities,shallbesubjecttoacivilpenaltyofnotlessthan$400.00foreach
violationandshallbeliablefortowingcharges.

(f)Individualswhohaveatemporaryambulatorydisabilitymayapplyfor
atemporaryremovablewindshieldplacardtotheCommissioneronaform
prescribedbyhimorhertheCommissioner.Theplacardshallbevalidfora
periodofuptosixmonthsanddisplayedasrequiredundertheprovisionsof
subsection(c)ofthissection.Theapplicationshallbesignedbyalicensed
physician,licensedphysicianassistant,orlicensedadvancedpractice
registerednurse.Thevalidationperiodofthetemporaryplacardshallbe
establishedonthebasisofthewrittenrecommendationfromalicensed
physician,licensedphysicianassistant,orlicensedadvancedpractice
registerednurse.TheCommissionershalladoptrulestoimplementthe
provisionsofthissubsection.

Sec.5.23V.S.A.§ 115(a)isamendedtoread:
(a)(1)AnyVermontresidentmaymakeapplicationtotheCommissioner
andbeissuedanidentificationcardthatisattestedbytheCommissionerasto
truename,correctage,residentialaddressunlessthelistingofanotheraddress
isrequestedbytheapplicantorisotherwiseauthorizedbylaw,andanyother
identifyingdataastheCommissionermayrequirethatshallinclude,inthe

caseofminorapplicants,thewrittenconsentoftheapplicant’sparent,

(2)Everyapplicationforanidentificationcardshallbesignedbythe
applicantandshallcontainsuchevidenceofageandidentityasthe
Commissionermayrequire,consistentwithsubsection(l)ofthissection.New
andrenewalapplicationformsshallincludeaspacefortheapplicanttorequest
thata“veteran”designationbeplacedontheapplicant’sidentificationcard.If
aveteran,asdefinedin38U.S.C.§101(2)andincludinganindividual
disabledduringactivemilitary,naval,air,orspaceservice,asdefinedin38
U.S.C.§101(24),requestsaveterandesignationandprovidesaDepartmentof
DefenseForm214orotherproofofveteranstatusspecifiedbythe

Nofees,includingtheannualemissionsfeerequiredpursuantto3V.S.A.
§ 2822(m)(1)andtheelectricvehicleinfrastructurefeesrequiredpursuantto

veteranoftheU.S.ArmedForceswhoreceivedadischargeunderotherthan

(b)(1)Notwithstandingtheprovisionsofsubsection(a)ofthissection,any
licensedpersonmayapplytotheCommissionerofMotorVehiclesfora
learner’spermitfortheoperationofamotorcycleintheformprescribedbythe
Commissioner.TheCommissionershallofferbothamotorcyclelearner’s
permitthatauthorizestheoperationofthree-wheeledmotorcyclesonlyanda
motorcyclelearner’spermitthatauthorizestheoperationofanymotorcycle.
TheCommissionershallrequirepaymentofafeeof$24.00atthetime
applicationismade,exceptthatnofeeshallbechargedforanindividualunder
23yearsofagewhowasinthecareandcustodyoftheCommissionerfor
ChildrenandFamiliespursuantto33V.S.A.§ 4903(4)inVermontafter
attaining14yearsofage.
(2)Aftertheapplicanthassuccessfullypassedallpartsoftheapplicable

exceptthatnofeeshallbechargedforanindividualunder23yearsofagewho
wasinthecareandcustodyoftheCommissionerforChildrenandFamilies
pursuantto33V.S.A.§ 4903(4)inVermontafterattaining14yearsofage.
(3)Amotorcyclelearner’spermitmayberenewedonlytwiceupon

withthatshadingortintingmaterialisnotlessthan70percent.

(c)Medicalexemption.TheCommissionermaygrantanexemptiontothe
prohibitionofthissectionuponapplicationfromapersonanindividual
requiredformedicalreasonstobeshieldedfromtheraysofthesunandwho
attachestotheapplicationadocumentsignedbyalicensedphysicianor
optometristcertifyingthatshieldingfromtheraysofthesunisamedical
necessity.Thephysicianoroptometristcertificationshallberenewedevery
fouryears.However,whenalicensedphysicianoroptometristhaspreviously
certifiedtotheCommissionerthatanapplicant’sconditionisbothpermanent
andstable,theexemptionmayberenewedbytheapplicantwithoutsubmission
ofaformsignedbyalicensedphysicianoroptometrist.Additionally,the
windowshadingortintingpermittedunderthissubsectionshallbelimitedto
theventwindowsorsidewindowslocatedimmediatelytotheleftandrightof
theoperator.Theexemptionprovidedinthissubsectionshallterminateupon
thetransferoftheapprovedvehicleandatthattimetheapplicablewindow
tintingshallberemovedbytheseller.Furthermore,ifthematerialdescribed
inthissubsectiontearsorbubblesorisotherwiseworntoprohibitclearvision,
itshallberemovedorreplaced.
(d)Rearsidewindowobstructions.Therearsidewindowsandtheback
windowmaybeobstructedonlyifthemotorvehicleisequippedoneachside
withasecurelyattachedmirror,whichthatprovidestheoperatorwithaclear
viewoftheroadwayintherearandonbothsidesofthemotorvehicle.

(e)Removal.Anyshadingortintingmaterialthatispaintedoradheredon
orover,orhunginbackof,thewindshield,ventwindows,orsidewindowsin
accordancewithsubdivision(b)(7)orsubsection(c)ofthissectionshallbe
removedifittears,bubbles,orisotherwiseworntoprohibitclearvision.
(f)Definition.Asusedinthissection,“visiblelighttransmission”means
theamountofvisiblelightthatcanpassthroughshading,tinting,orglazing
materialappliedtoorwithinthetransparentportionofawindoworwindshield
ofamotorvehicle.

ItistheintentoftheGeneralAssemblythatamotorvehiclewithshadingor
tintingmaterialthatisnotallowedunder23V.S.A.§ 1125,asamendedby
Sec.39ofthisact,posesadangertotheindividualoperatingthemotor
vehicle,anypassengersinthemotorvehicle,andotherhighwayusersandthat
suchamotorvehicleshallfailtheannualsafetyinspectionrequiredunder
23 V.S.A.§ 1222.

amountthatausedvehiclewaspurchasedfor,ifthedifferencebetweenthe
purchasepriceandthecleantrade-invalueofthevehicleisequaltoorless
thanthecostofrepairsnecessaryforthevehicletopassinspectionpursuantto
23V.S.A.§ 1222;and
(3)theassessmentofthepurchaseandusetaxonvehiclesthatwere
purchasedandfirstregisteredinanotherstatepriortothevehicleowner
