BILL AS INTRODUCED S.146 2025 Page 1 of 3 VT LEG #382265 v.2 S.146 1 Introduced by Senators White and Harrison 2 Referred to Committee on 3 Date: 4 Subject: Transportation; labor; transportation demand management 5 Statement of purpose of bill as introduced: This bill proposes to require certain 6 employers to establish a transportation demand management plan. 7 An act relating to transportation demand management plans 8 It is hereby enacted by the General Assembly of the State of Vermont: 9 Sec. 1. 21 V.S.A. chapter 23 is added to read: 10 CHAPTER 23. EMPLOYER PROVIDED TRANSPORTATION DEMAND 11 MANAGEMENT PLAN 12 § 1801. DEFINITIONS 13 As used in this chapter: 14 (1) “Employee” has the same meaning as in section 341 of this title. 15 (2) “Employer” has the same meaning as in section 341 of this title. 16 (3) “Transportation demand management” or “TDM” means measures 17 that reduce vehicle miles traveled. Examples include telecommuting; 18 incentives to carpool, walk, bicycle, or ride public transit; and staggered work 19 shifts. 20 BILL AS INTRODUCED S.146 2025 Page 2 of 3 VT LEG #382265 v.2 (4) “Transportation management association” or “TMA” means a 1 nonprofit, member-controlled organization that provides transportation 2 services in a particular area, such as a region, municipality, commercial 3 district, mall, medical center, or industrial park, and an institutional framework 4 for transportation demand management. 5 § 1802. TRANSPORTATION DEMAND MANAGEMENT PLAN 6 REQUIRED 7 (a) Adoption of a transportation demand management plan. Each employer 8 that has 50 or more employees performing services for it at a workplace in the 9 State shall design, adopt, and implement a TDM plan for that workplace that 10 includes measures to reduce vehicle miles traveled. 11 (b) Employer resources. All employers required to design, adopt, and 12 implement a TDM plan pursuant to subsection (a) of this section shall consult 13 one or more of the following in developing and implementing a TDM plan and 14 other TDM measures: 15 (1) the Agency of Transportation’s Transportation Demand 16 Management (TDM) Guidance document, as updated; 17 (2) existing transportation management associations, including Go! 18 Vermont; 19 (3) mass transit authorities formed pursuant to 24 V.S.A. chapter 127; 20 (4) municipalities; and 21 BILL AS INTRODUCED S.146 2025 Page 3 of 3 VT LEG #382265 v.2 (5) municipal and regional planning commissions created pursuant to 1 24 V.S.A. chapter 117. 2 § 1803. RULEMAKING 3 The Secretary of Transportation, in consultation with stakeholders, may 4 adopt rules pursuant to 3 V.S.A chapter 25 to establish requirements for the 5 content of transportation demand management plans and to implement the 6 provisions of this section. 7 Sec. 2. EFFECTIVE DATE 8 This act shall take effect on passage, and employers that are required to 9 adopt and implement a transportation demand management plan pursuant to 10 this act shall do so not later than January 1, 2026. 11
