1212 AN ACT to create 71.05 (6) (b) 57., 71.26 (1) (j), 71.45 (1) (e) and 253.17 of the
1313 statutes; relating to: childhood obesity prevention and management grants.
1414 Analysis by the Legislative Reference Bureau
1515 This bill requires the Department of Health Services, in coordination with
1616 relevant state agencies, to award two-year grants to organizations, cities, villages,
1717 towns, counties, school districts, or Indian tribes for childhood obesity prevention
1818 and management programs.  Under the bill, “childhood obesity prevention and
1919 management program” means any of the following designed to assist a person who
2020 is 22 years of age or younger or an unborn child (collectively, “child”):
2121 1.  Early interventions and screenings to better identify and promote healthy
2222 growth and development and to prevent and manage childhood obesity.
2323 2.  Parental support for and education on childhood weight management,
2424 including support for guardians, caregivers, or others who have or will have
2525 responsibility for the child other than the parent.
2626 3.  Removal of barriers and promotion of better access to proper nutrition and
2727 spaces for play and other physical activities.
2828 4.  School-based efforts to impact circumstances contributing to childhood
2929 weight management.
3030 5.  Early childhood care and education, including both school-based and
3131 out-of-school care efforts to impact circumstances contributing to healthy growth
3232 and development and reduce childhood obesity.
3333 6.  Any other type of program, approach, or innovative practice that addresses
3434 the factors that prevent childhood obesity and mitigate its impact.

3939 The bill prohibits DHS from awarding a grant unless the applicant
4040 demonstrates that its program includes or will include participation of both a child
4141 and the child's parent or guardian (unless the child is not born or the child is 18 years
4242 of age or older), the applicant agrees to provide nonidentifying data on program
4343 results and effectiveness, and the applicant contributes matching funds or in-kind
4444 services with a value equal to at least 25 percent of the grant amount.  The bill
4545 requires DHS to prioritize applications in which all of the applicant's matching funds
4646 or in-kind services are provided by nongovernmental entities and then, if sufficient
4747 funds are available, applications with the most matching funds or in-kind services
4848 provided by nongovernmental entities.
4949 The bill allows DHS to renew a grant at the end of the two-year grant period.
5050 If sufficient funds are available, the bill requires DHS to renew a grant at the same
5151 amount previously awarded if all of the grant recipient's matching funds or in-kind
5252 services are provided by nongovernmental entities and the recipient has shown to
5353 DHS's satisfaction that the program is effective.  The bill allows DHS to renew a
5454 grant at a higher amount than previously awarded if the recipient has increased the
5555 amount of matching funds or in-kind services provided by nongovernmental
5656 entities.
5757 Under the bill, DHS must submit an annual report on the childhood obesity
5858 prevention and management program grants to the legislature.
5959 The bill also provides an individual income tax subtraction and a corporate
6060 income and franchise tax exemption for any amount of money or in-kind services
6161 provided to a grant recipient that is used to satisfy the matching requirement under
6262 the bill.
6363 Because this bill relates to an exemption from state or local taxes, it may be
6464 referred to the Joint Survey Committee on Tax Exemptions for a report to be printed
6565 as an appendix to the bill.
6666 For further information see the state fiscal estimate, which will be printed as
6767 an appendix to this bill.
6868 The people of the state of Wisconsin, represented in senate and assembly, do
6969 enact as follows:
7070 SECTION 1. 71.05 (6) (b) 57. of the statutes is created to read:
7171 71.05 (6) (b) 57.  For taxable years beginning after December 31, 2023, any
7272 amount of money or in-kind services provided to a recipient of a grant under s. 253.17
7373 that is used by the grant recipient to satisfy the matching requirement under s.
7474 253.17 (3) (c).
7575 SECTION 2. 71.26 (1) (j) of the statutes is created to read:

8686 71.26 (1) (j)  Money or services used for satisfying childhood obesity prevention
8787 and management grant matching requirement.  For taxable years beginning after
8888 December 31, 2023, any amount of money or in-kind services provided to a recipient
8989 of a grant under s. 253.17 that is used by the grant recipient to satisfy the matching
9090 requirement under s. 253.17 (3) (c).
9191 SECTION 3. 71.45 (1) (e) of the statutes is created to read:
9292 71.45 (1) (e)  Money or services used for satisfying childhood obesity prevention
9393 and management grant matching requirement.  For taxable years beginning after
9494 December 31, 2023, any amount of money or in-kind services provided to a recipient
9595 of a grant under s. 253.17 that is used by the grant recipient to satisfy the matching
9696 requirement under s. 253.17 (3) (c).
9797 SECTION 4. 253.17 of the statutes is created to read:
9898 253.17  Childhood obesity prevention and management grants.   (1)  In
9999 this section:
100100 (a)  “Child” means an individual who is 22 years of age or younger or an unborn
101101 child.
102102 (b)  “Childhood obesity prevention and management program” means any of the
103103 following designed to assist a child:
104104 1.  Early interventions and screenings to better identify and promote healthy
105105 growth and development and to prevent and manage childhood obesity.
106106 2.  Parental support for and education on childhood weight management,
107107 including support for guardians, caregivers, or others who have or will have
108108 responsibility for the child other than the parent.
109109 3.  Removal of barriers and promotion of better access to proper nutrition and
110110 spaces for play and other physical activities.

138138 4.  School-based efforts to impact circumstances contributing to childhood
139139 weight management.
140140 5.  Early childhood care and education, including both school-based and
141141 out-of-school care efforts to impact circumstances contributing to healthy growth
142142 and development and reduce childhood obesity.
143143 6.  Any other type of program, approach, or innovative practice that addresses
144144 the factors that prevent childhood obesity and mitigate its impact.
145145 (2)  The department, in coordination with relevant state agencies, shall award
146146 grants to organizations, coalitions of organizations, cities, villages, towns, counties,
147147 school districts, or Indian tribes in this state for childhood obesity prevention and
148148 management programs.  The department shall award a grant under this section for
149149 a 2-year period.
150150 (3)  The department may not award a grant under this section unless the
151151 applicant demonstrates all of the following:
152152 (a)  The applicant's childhood obesity prevention and management program
153153 includes or will include participation of both a child and the child's parent or
154154 guardian, except for all of the following:
155155 1.  If the child is 18 years of age or older, the child's parent or guardian need not
156156 participate.
157157 2.  If the child is not born, only the parent's participation is required.
158158 (b)  The applicant agrees to provide the department with nonidentifying data
159159 on program results and effectiveness.
160160 (c)  The applicant contributes matching funds or in-kind services with a value
161161 equal to at least 25 percent of the grant amount requested.

190190 (4)  In awarding a grant under this section, the department shall give first
191191 priority to applications in which all of the applicant's matching funds or in-kind
192192 services are provided by nongovernmental entities.  If sufficient funds are available,
193193 the department shall then give priority to applications with the most matching funds
194194 or in-kind services provided by nongovernmental entities.
195195 (5) (a)  Subject to pars. (b) and (c), the department may renew a grant at the end
196196 of the 2-year grant period.
197197 (b)  If sufficient funds are available, the department shall renew a grant at the
198198 same amount previously awarded if all of the following are true:
199199 1.  The renewal request is from a grant recipient for which all matching funds
200200 or in-kind services will be provided by nongovernmental entities or a grant recipient,
201201 regardless of whether the grant recipient met this standard for the previous grant.
202202 2.  The grant recipient has provided evidence satisfactory to the department
203203 showing that its childhood obesity prevention and management program is effective.
204204 (c)  The department may renew a grant at a higher amount than previously
205205 awarded if the grant recipient has increased the amount of matching funds or
206206 in-kind services provided by nongovernmental entities.
207207 (6)  On an annual basis, the department shall submit a report to the legislature
208208 under s. 13.172 (2) on the grant program under this section.  The report shall include
209209 all of the following:
210210 (a)  A description of each type of program funded.
211211 (b)  The percentages of nongovernmental matching funds and in-kind services
212212 offered by each grant recipient.
213213 (c)  The number of participants enrolled in or reached by each funded childhood
214214 obesity prevention and management program.

242242 (d)  To the extent applicable, the number of participants who completed each
243243 funded childhood obesity prevention and management program.
244244 (e)  The effectiveness of each funded childhood obesity prevention and
245245 management program to address factors related to childhood obesity.
