15 | 15 | | This bill requires the Department of Health Services, in coordination with |
---|
16 | 16 | | relevant state agencies, to award two-year grants to organizations, cities, villages, |
---|
17 | 17 | | towns, counties, school districts, or Indian tribes for childhood obesity prevention |
---|
18 | 18 | | and management programs. Under the bill, “childhood obesity prevention and |
---|
19 | 19 | | management program” means any of the following designed to assist a person who |
---|
20 | 20 | | is 22 years of age or younger or an unborn child (collectively, “child”): |
---|
21 | 21 | | 1. Early interventions and screenings to better identify and promote healthy |
---|
22 | 22 | | growth and development and to prevent and manage childhood obesity. |
---|
23 | 23 | | 2. Parental support for and education on childhood weight management, |
---|
24 | 24 | | including support for guardians, caregivers, or others who have or will have |
---|
25 | 25 | | responsibility for the child other than the parent. |
---|
26 | 26 | | 3. Removal of barriers and promotion of better access to proper nutrition and |
---|
27 | 27 | | spaces for play and other physical activities. |
---|
28 | 28 | | 4. School-based efforts to impact circumstances contributing to childhood |
---|
29 | 29 | | weight management. |
---|
30 | 30 | | 5. Early childhood care and education, including both school-based and |
---|
31 | 31 | | out-of-school care efforts to impact circumstances contributing to healthy growth |
---|
32 | 32 | | and development and reduce childhood obesity. |

33 | 33 | | 6. Any other type of program, approach, or innovative practice that addresses |

34 | 34 | | the factors that prevent childhood obesity and mitigate its impact. |

39 | 39 | | The bill prohibits DHS from awarding a grant unless the applicant |
---|
40 | 40 | | demonstrates that its program includes or will include participation of both a child |
---|
41 | 41 | | and the child's parent or guardian (unless the child is not born or the child is 18 years |
---|
42 | 42 | | of age or older), the applicant agrees to provide nonidentifying data on program |
---|
43 | 43 | | results and effectiveness, and the applicant contributes matching funds or in-kind |
---|
44 | 44 | | services with a value equal to at least 25 percent of the grant amount. The bill |
---|
45 | 45 | | requires DHS to prioritize applications in which all of the applicant's matching funds |
---|
46 | 46 | | or in-kind services are provided by nongovernmental entities and then, if sufficient |
---|
47 | 47 | | funds are available, applications with the most matching funds or in-kind services |
---|
48 | 48 | | provided by nongovernmental entities. |
---|
49 | 49 | | The bill allows DHS to renew a grant at the end of the two-year grant period. |
---|
50 | 50 | | If sufficient funds are available, the bill requires DHS to renew a grant at the same |
---|
51 | 51 | | amount previously awarded if all of the grant recipient's matching funds or in-kind |
---|
52 | 52 | | services are provided by nongovernmental entities and the recipient has shown to |
---|
53 | 53 | | DHS's satisfaction that the program is effective. The bill allows DHS to renew a |
---|
54 | 54 | | grant at a higher amount than previously awarded if the recipient has increased the |
---|
55 | 55 | | amount of matching funds or in-kind services provided by nongovernmental |
---|
56 | 56 | | entities. |
---|
57 | 57 | | Under the bill, DHS must submit an annual report on the childhood obesity |
---|
58 | 58 | | prevention and management program grants to the legislature. |
---|
59 | 59 | | The bill also provides an individual income tax subtraction and a corporate |
---|
60 | 60 | | income and franchise tax exemption for any amount of money or in-kind services |
---|
61 | 61 | | provided to a grant recipient that is used to satisfy the matching requirement under |
---|
62 | 62 | | the bill. |
---|
63 | 63 | | Because this bill relates to an exemption from state or local taxes, it may be |
---|
64 | 64 | | referred to the Joint Survey Committee on Tax Exemptions for a report to be printed |
---|
65 | 65 | | as an appendix to the bill. |
---|

145 | 145 | | (2) The department, in coordination with relevant state agencies, shall award |
---|
146 | 146 | | grants to organizations, coalitions of organizations, cities, villages, towns, counties, |
---|
147 | 147 | | school districts, or Indian tribes in this state for childhood obesity prevention and |
---|
148 | 148 | | management programs. The department shall award a grant under this section for |
---|
149 | 149 | | a 2-year period. |
---|
150 | 150 | | (3) The department may not award a grant under this section unless the |
---|
151 | 151 | | applicant demonstrates all of the following: |
---|
152 | 152 | | (a) The applicant's childhood obesity prevention and management program |
---|
153 | 153 | | includes or will include participation of both a child and the child's parent or |
---|
154 | 154 | | guardian, except for all of the following: |
---|
155 | 155 | | 1. If the child is 18 years of age or older, the child's parent or guardian need not |
---|
156 | 156 | | participate. |
---|
157 | 157 | | 2. If the child is not born, only the parent's participation is required. |
---|
158 | 158 | | (b) The applicant agrees to provide the department with nonidentifying data |
---|
159 | 159 | | on program results and effectiveness. |
---|
160 | 160 | | (c) The applicant contributes matching funds or in-kind services with a value |
---|
161 | 161 | | equal to at least 25 percent of the grant amount requested. |
---|

191 | 191 | | priority to applications in which all of the applicant's matching funds or in-kind |

192 | 192 | | services are provided by nongovernmental entities. If sufficient funds are available, |

193 | 193 | | the department shall then give priority to applications with the most matching funds |
---|
194 | 194 | | or in-kind services provided by nongovernmental entities. |
---|
195 | 195 | | (5) (a) Subject to pars. (b) and (c), the department may renew a grant at the end |
---|
196 | 196 | | of the 2-year grant period. |
---|
197 | 197 | | (b) If sufficient funds are available, the department shall renew a grant at the |
---|
198 | 198 | | same amount previously awarded if all of the following are true: |
---|
199 | 199 | | 1. The renewal request is from a grant recipient for which all matching funds |
---|
200 | 200 | | or in-kind services will be provided by nongovernmental entities or a grant recipient, |
---|
201 | 201 | | regardless of whether the grant recipient met this standard for the previous grant. |
---|
202 | 202 | | 2. The grant recipient has provided evidence satisfactory to the department |
---|
203 | 203 | | showing that its childhood obesity prevention and management program is effective. |
---|
204 | 204 | | (c) The department may renew a grant at a higher amount than previously |
---|
205 | 205 | | awarded if the grant recipient has increased the amount of matching funds or |
---|
206 | 206 | | in-kind services provided by nongovernmental entities. |
---|
207 | 207 | | (6) On an annual basis, the department shall submit a report to the legislature |
---|
208 | 208 | | under s. 13.172 (2) on the grant program under this section. The report shall include |
---|
209 | 209 | | all of the following: |
---|
210 | 210 | | (a) A description of each type of program funded. |
---|
211 | 211 | | (b) The percentages of nongovernmental matching funds and in-kind services |
---|
212 | 212 | | offered by each grant recipient. |
---|
213 | 213 | | (c) The number of participants enrolled in or reached by each funded childhood |
---|
214 | 214 | | obesity prevention and management program. |
