2023 Assembly Bill 1016 Assembly Amendment 1 
2023 ASSEMBLY BILL 1016 
2023 Assembly Bill 1016 requires that a school board, governing body of a private school participating 
in a parental choice program, and governing board of a charter school must ensure that during each 
week of a school term at least 180 minutes of physical activity are offered to pupils in the elementary 
grades during school hours. 
ASSEMBLY AMENDMENT 1 
Assembly Amendment 1 removes the requirement that the 180 hours of physical activity must be 
offered to pupils during school hours.

On February 9, 2024, Representative Penterman offered Assembly Amendment 1. On February 14, 
2024, the Assembly Committee on Health, Aging and Long-Term Care recommended adoption of 
Assembly Amendment 1, on a vote of Ayes, 15; Noes, 0, and passage of the bill, as amended, on a vote of 
Ayes, 8; Noes, 7.
