2023 Wisconsin Act 101
[2023 Assembly Bill 1023]
Child and Dependent Care Tax
Credit
Under state law in effect through tax year 2023, if a full-time Wisconsin resident is eligible to claim the
federal child and dependent care tax credit, that individual may also claim a state child and dependent
care tax credit in an amount equal to 50 percent of the federal credit claimed for the same taxable year.
Beginning with tax year 2024, 2023 Wisconsin Act 101 increases the state child and dependent care tax
credit in two ways. First, the act increases the amount of the state credit to 100 percent of the federal
credit. Second, for purposes of calculating the state credit, the act specifies the eligible work-related
expense limits as $10,000 for one qualifying dependent and $20,000 for two or more qualifying
dependents, in lieu of lower amounts allowed under current federal law.
Effective date: March 6, 2024.
