10	10	AN ACT to renumber and amend 77.51 (9) (e); and to create 77.51 (9) (e) 1. and
11	11	2. of the statutes; relating to: the sales and use tax exemption for personal
12	12	farm property or household goods sold by auction on the Internet.

14	14	Current law provides a sales and use tax exemption for five or fewer auctions
15	15	for the sale of personal farm property or household goods that are held by the same
16	16	auctioneer at the same location during the year. This bill provides that the
17	17	exemption applies to five or fewer auction events that are the sale of such property
18	18	or goods held by the same auctioneer at the same location during the year. Under
19	19	the bill, an auction event is the total number of consecutive days for which property
20	20	at that location is available for bidding. With respect to an auction for which all or
21	21	some of the bids may be submitted over the Internet, an auction event is the total
22	22	number of consecutive days that winning bids are selected, regardless of whether the
23	23	property being sold is at multiple locations.
24	24	Because this bill relates to an exemption from state or local taxes, it may be
25	25	referred to the Joint Survey Committee on Tax Exemptions for a report to be printed
26	26	as an appendix to the bill.

29	29	The people of the state of Wisconsin, represented in senate and assembly, do
30	30	enact as follows:

36	36	SECTION 1. 77.51 (9) (e) of the statutes is renumbered 77.51 (9) (e) (intro.) and
37	37	amended to read:
38	38	77.51 (9) (e) (intro.) Five or fewer auctions auction events that are the sale of
39	39	personal farm property or household goods and that are held by the same auctioneer
40	40	at the same location during the year. For purposes of this paragraph, an auction
41	41	event is the total number of consecutive days for which property at that location is
42	42	available for bidding. With respect to an auction for which all or some of the bids may
43	43	be submitted over the Internet, an auction event is the total number of consecutive
44	44	days that winning bids are selected, regardless of whether the property being sold
45	45	is at multiple locations. In this paragraph, with respect to indoor locations, “location"
46	46	means a building, except that in the case of a shopping center or a shopping mall
47	47	“location" means a store.:
48	48	SECTION 2. 77.51 (9) (e) 1. and 2. of the statutes are created to read:
49	49	77.51 (9) (e) 1. “Auctioneer” means a person, including an auction company as
50	50	defined in s. 480.01 (2), that is licensed to conduct an auction under the laws of this
51	51	state.
52	52	2. “Location” means the building or street address where the property to be
53	53	auctioned is physically located at the time of the auction. With respect to a shopping
54	54	center or shopping mall, “location” means a store.
55	55	SECTION 3.0Effective date.
56	56	(1) This act takes effect on the first day of the 3rd month beginning after
57	57	publication.
