13	13	of the statutes; relating to: courtroom supports for and sealing the identifying
14	14	information of child victims and child witnesses of human trafficking crimes.

16	16	Current law provides certain additional rights and protections to victims and
17	17	witnesses during their involvement with the criminal justice or juvenile justice
18	18	system.
19	19	This bill provides that child victims or child witnesses of human trafficking
20	20	crimes must be provided any courtroom supports that the court finds necessary to
21	21	support the health, safety, or liberty of the child and determines are in the interest
22	22	of justice.
23	23	The bill also provides that in any criminal proceeding for a human trafficking
24	24	violation or civil action for injury due to human trafficking, a child victim's or child
25	25	witness's identifying information must be sealed and may not be disclosed to the
26	26	public unless the court orders the disclosure to be made after a hearing in which the
27	27	court takes into consideration the health, safety, and liberty of the child and
28	28	determines that the disclosure is in the interest of justice.

31	31	The people of the state of Wisconsin, represented in senate and assembly, do
32	32	enact as follows:

37	37	SECTION 1 ASSEMBLY BILL 1052
38	38	SECTION 1. 940.302 (4) of the statutes is created to read:
39	39	940.302 (4) In any criminal proceeding for a violation of sub. (2) or civil action
40	40	under sub. (3), the identifying information of a child victim or child witness shall be
41	41	sealed and may not be disclosed to the public unless the court orders the disclosure
42	42	to be made after a hearing in which the court takes into consideration the health,
43	43	safety, and liberty of the child and determines that the disclosure is in the interest
44	44	of justice.
45	45	SECTION 2. 948.051 (4) of the statutes is created to read:
46	46	948.051 (4) In any criminal proceeding for a violation of sub. (1) or (2) or civil
47	47	action under sub. (3), the identifying information of a child victim or child witness
48	48	shall be sealed and may not be disclosed to the public unless the court orders the
49	49	disclosure to be made after a hearing in which the court takes into consideration the
50	50	health, safety, and liberty of the child and determines that the disclosure is in the
51	51	interest of justice.
52	52	SECTION 3. 950.04 (1v) (eg) of the statutes is created to read:
53	53	950.04 (1v) (eg) If the victim is a child, in any criminal proceeding for a
54	54	violation of s. 940.302 or 948.051, to be provided any courtroom supports that the
55	55	court finds necessary to support the health, safety, or liberty of the child and
56	56	determines are in the interest of justice.
57	57	SECTION 4. 950.04 (2w) (fg) of the statutes is created to read:
58	58	950.04 (2w) (fg) If the witness is a child, in any criminal proceeding for a
59	59	violation of s. 940.302 or 948.051, to be provided any courtroom supports that the
60	60	court finds necessary to support the health, safety, or liberty of the child and
61	61	determines are in the interest of justice.
