AN ACT to create 973.06 (1) (k) of the statutes; relating to: recovery of law
enforcement agency costs for administration of naloxone or another opioid
antagonist.
Analysis by the Legislative Reference Bureau
Current law provides that a sentencing court may order a criminal defendant
to pay certain costs, including the costs of a law enforcement agency withdrawing a
defendant's blood in certain cases when intoxication is an element of the offense.
This bill provides that a sentencing court may order a criminal defendant to pay a
law enforcement agency's costs of administration of naloxone or another opioid
antagonist to a defendant if the defendant was undergoing or was believed to be
undergoing an opioid-related drug overdose during the course of the investigation
that resulted in the conviction.

an appendix to this bill.
The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
SECTION 1. 973.06 (1) (k) of the statutes is created to read:
973.06 (1) (k) Any costs incurred by a law enforcement agency for the
administration of naloxone or another opioid antagonist to the defendant if the

defendant was undergoing or was believed to be undergoing an opioid-related drug
overdose during the course of the investigation that resulted in the conviction.
Notwithstanding sub. (2), the court may not remit these costs.
