15 | 15 | | provided (water customer) for the purpose of assisting the water customer in |
---|
16 | 16 | | replacing customer-side water service lines containing lead if 1) the city, town, or |
---|
17 | 17 | | village has enacted an ordinance permitting the water public utility to do so and |
---|
18 | 18 | | requiring water customers to replace any customer-side water service lines |
---|
19 | 19 | | containing lead, and 2) the utility-side water service line and the water main pipe |
---|
20 | 20 | | that are connected to the customer-side water service line do not contain lead or the |
---|
21 | 21 | | lead-containing portion of that line or pipe is replaced at the same time as the |
---|
22 | 22 | | customer-side water service line is replaced. |
---|
23 | 23 | | This bill specifies that “financial assistance” under this program is funded from |
---|
24 | 24 | | utility rates. Also under the bill, a utility may, without PSC approval, administer a |
---|
25 | 25 | | municipal program to assist water customers in complying with a city, village, or |
---|
26 | 26 | | town ordinance requiring the replacement of customer-side water service lines |
---|
27 | 27 | | containing lead and to provide municipal grants or loans to water customers for that |
---|
28 | 28 | | purpose, provided the utility does not give financial assistance to water customers |
---|
29 | 29 | | under the program. |

35 | 35 | | Under the bill, if a political subdivision makes a loan to an owner of a premises |
---|
36 | 36 | | for the purpose of replacing customer-side water service lines and collects the |
---|
37 | 37 | | amounts due under the loan as a special charge, the political subdivision must |
---|
38 | 38 | | provide the owner of the premises with an annual notice that includes 1) the loan |
---|
39 | 39 | | term, 2) the current year for which the property owner is paying the special charge |
---|
40 | 40 | | and the amount owed for that year, and 3) the current loan balance. |

43 | 43 | | The people of the state of Wisconsin, represented in senate and assembly, do |
---|
44 | 44 | | enact as follows: |

45 | 45 | | SECTION 1. 66.0627 (8) (as) of the statutes is created to read: |
---|
46 | 46 | | 66.0627 (8) (as) If a political subdivision makes a loan under par. (ag) and |
---|
47 | 47 | | collects the loan repayments as a special charge under par. (am), the political |
---|
48 | 48 | | subdivision shall provide the owner of the premises with an annual notice that |
---|
49 | 49 | | includes all of the following: |
---|
50 | 50 | | 1. The loan term. |
---|
51 | 51 | | 2. The current year for which the owner of the premises is paying the special |
---|
52 | 52 | | charge and the amount owed for that year. |
---|
53 | 53 | | 3. The current loan balance. |
---|
54 | 54 | | SECTION 2. 196.372 (1) (b) of the statutes is amended to read: |

55 | 55 | | 196.372 (1) (b) “Financial assistance” means a grant, loan, or combination |
---|
56 | 56 | | thereof that is funded from utility rates. |

57 | 57 | | SECTION 3. 196.372 (4) of the statutes is created to read: |

58 | 58 | | 196.372 (4) MUNICIPAL ORDINANCE ASSISTANCE. (a) In this subsection, “water |

59 | 59 | | customer” means an owner of property to which a water public utility provides water |
---|
60 | 60 | | utility service. |

61 | 61 | | (b) Notwithstanding sub. (3), a water public utility may, without commission |
