13 | 13 | | Housing and Economic Development Authority for the purpose of issuing loans, |

14 | 14 | | which the bill terms “workforce home loans,” to eligible applicants to provide gap |
---|
15 | 15 | | financing to supplement a conventional mortgage for the purchase of a single-family |
---|
16 | 16 | | residence in Wisconsin, whether new construction or an existing residence and |
---|
17 | 17 | | whether detached or attached, that will be the eligible applicant's primary residence. |
---|
18 | 18 | | The bill requires WHEDA to use repayments of workforce home loans to fund |
---|
19 | 19 | | additional loans under the program. |
---|
20 | 20 | | The bill prohibits WHEDA from charging any interest for a workforce home |
---|
21 | 21 | | loan, and workforce home loans are not forgivable in whole or in part. Each |
---|
22 | 22 | | workforce home loan must be secured as a second lien real estate mortgage. The loan |
---|
23 | 23 | | term is 30 years, except that the loan term may be extended to 40 years for certain |
---|
24 | 24 | | applicants who qualify for limited workforce home loan payment deferral, as |
---|
25 | 25 | | provided in the bill, and a workforce home loan may be prepaid in whole or in part |

26 | 26 | | at any time without penalty. Under the bill, the total amount of unpaid principal on |

27 | 27 | | a workforce home loan becomes due and payable upon the occurrence of any of the |

---|
30 | 30 | | 2. No recipient of the workforce home loan continues to reside in the home as |

37 | 37 | | community-based organization or other qualified local organization, as determined |

38 | 38 | | by WHEDA, certifies that a loan applicant is eligible to receive a workforce home |

39 | 39 | | loan, subject to WHEDA's approval. An applicant is eligible for a workforce home |
---|
40 | 40 | | loan under the bill if all of the following are satisfied: |

41 | 41 | | 1. The applicant has not had any ownership interest in residential real |
---|
42 | 42 | | property for the three consecutive years immediately preceding the date of the |
---|
43 | 43 | | application. |
---|
44 | 44 | | 2. The applicant's annual household compliance income equals 100 percent or |
---|
45 | 45 | | less of the area median family income for the county in which the home is located, |
---|
46 | 46 | | not adjusted for family size, as established by the Federal Housing Finance Agency. |
---|
47 | 47 | | Under the bill, household compliance income means the anticipated combined |
---|
48 | 48 | | income, as determined by WHEDA according to its conventional first-time home |
---|
49 | 49 | | buyer first mortgage program underwriting guidelines (underwriting guidelines), of |
---|
50 | 50 | | all individuals age 18 or older who intend to occupy the residence subject to a |
---|
51 | 51 | | workforce home loan, regardless of whether the individual is an applicant for the |
---|
52 | 52 | | workforce home loan and regardless of the individual's relationship to the applicant |
---|
53 | 53 | | for the workforce home loan. |
---|
54 | 54 | | 3. The applicant's debt-to-income ratio, calculated by WHEDA as provided in |
---|
55 | 55 | | the bill, satisfies WHEDA's underwriting guidelines. |
---|
56 | 56 | | 4. The applicant's credit score, rating, or other classification, as determined by |
---|
57 | 57 | | WHEDA, satisfies WHEDA's underwriting guidelines. |
---|
58 | 58 | | 5. Unless payments on a workforce home loan are deferred for at least 60 |
---|
59 | 59 | | months, the applicant's minimum financial reserves after down payment and closing |
---|
60 | 60 | | costs for the applicant's conventional mortgage for the purchase of the residence |
---|
61 | 61 | | subject to the workforce home loan satisfy WHEDA's underwriting guidelines. |
---|
62 | 62 | | 6. The applicant's conventional first mortgage for the purchase of the residence |
---|
63 | 63 | | subject to the workforce home loan is a fully amortizing, fixed-rate qualified |
---|
64 | 64 | | mortgage loan with a term of 30 or fewer years. |
---|
65 | 65 | | 7. The applicant satisfies all eligibility requirements with respect to citizenship |
---|
66 | 66 | | or resident alien status, social security number validity, home buyer education and |
---|
67 | 67 | | counseling, and payment of child support or maintenance if owed, as provided in |
---|
68 | 68 | | WHEDA's underwriting guidelines. |
---|
69 | 69 | | Under the bill, WHEDA may not issue a workforce home loan that exceeds the |
---|
70 | 70 | | lesser of the following: |
---|
71 | 71 | | 1. $60,000, adjusted for inflation. |
---|
72 | 72 | | 2. Twenty-five percent of the purchase price or fair market value of the home, |
---|
73 | 73 | | whichever is less. |
---|
74 | 74 | | The bill establishes different repayment rules for workforce home loans |
---|
75 | 75 | | depending on an eligible applicant's household compliance income. Specifically, if |
---|
76 | 76 | | WHEDA issues a workforce home loan to an eligible applicant whose household |

77 | 77 | | compliance income is 80 percent or less, but more than 60 percent, of the area median |

91 | 91 | | Finally, the bill requires that WHEDA subordinate an outstanding workforce |

92 | 92 | | home loan to a new first mortgage loan obtained by the recipient of the workforce |
---|
93 | 93 | | home loan on the basis of rules provided in the bill. |
---|
94 | 94 | | Because this bill may increase or decrease, directly or indirectly, the cost of the |
---|
95 | 95 | | development, construction, financing, purchasing, sale, ownership, or availability of |
---|
96 | 96 | | housing in this state, the Department of Administration, as required by law, will |
---|
97 | 97 | | prepare a report to be printed as an appendix to this bill. |
---|

100 | 100 | | The people of the state of Wisconsin, represented in senate and assembly, do |
---|

102 | 102 | | SECTION 1. 234.665 of the statutes is created to read: |

103 | 103 | | 234.665 Workforce home loan revolving loan program. (1) DEFINITIONS. |
---|
104 | 104 | | In this section: |
---|
105 | 105 | | (a) “Applicant” means each person who is a member of a household and who is |
---|
106 | 106 | | applying for a workforce home loan on behalf of that household. |
---|
107 | 107 | | (b) “Area median income” means the area median family income in the county |
---|
108 | 108 | | in which the residence is located, not adjusted for family size, as determined by the |
---|
109 | 109 | | federal housing finance agency. |
---|
110 | 110 | | (c) “Household compliance income” means the anticipated combined income, |
---|
111 | 111 | | as determined by the authority according to its underwriting guidelines, of all |
---|
112 | 112 | | individuals age 18 or older who intend to occupy the residence subject to a workforce |
---|
113 | 113 | | home loan, regardless of whether the individual is the applicant for the workforce |

130 | 130 | | (d) “Qualified organization” means an authorized lender, as defined in s. 234.59 |
---|
131 | 131 | | (1) (a), or a housing authority, as defined in s. 16.301 (2) (a), a community based |
---|
132 | 132 | | organization, as defined in s 16.301 (1), or another qualified local organization, as |
---|
133 | 133 | | determined by the authority. |
---|
134 | 134 | | (e) “Qualifying income” means the sum of the income of all eligible applicants |
---|
135 | 135 | | in the household for purposes of assessing the combined ability of all applicants in |
---|
136 | 136 | | the household to repay the workforce home loan, as determined by the authority |
---|
137 | 137 | | according to its underwriting guidelines. |
---|
138 | 138 | | (f) “Underwriting guidelines” means the authority's conventional first-time |
---|
139 | 139 | | home buyer first mortgage program underwriting guidelines. |
---|
140 | 140 | | (g) “Workforce home loan” means a loan issued by the authority under sub. (4) |
---|
141 | 141 | | (a). |
---|
142 | 142 | | (2) ESTABLISHMENT OF PROGRAM. The authority shall establish and administer |
---|
143 | 143 | | a workforce home loan revolving loan program for the purpose of awarding loans |
---|
144 | 144 | | under this section. |
---|
145 | 145 | | (3) CERTIFICATIONS. (a) A qualified organization may certify that an applicant |
---|
146 | 146 | | is eligible to receive a workforce home loan in an amount determined by the qualified |
---|
147 | 147 | | organization, subject to the approval of the authority. |
---|
148 | 148 | | (b) An applicant for a workforce home loan is eligible if the applicant satisfies |
---|
149 | 149 | | all of the following: |
---|
150 | 150 | | 1. The applicant has not had any ownership interest in residential real |
---|

---|

190 | 190 | | the authority, satisfies the underwriting guidelines, except that if the payments on |

191 | 191 | | a workforce home loan are deferred for at least 60 months, the minimum qualifying |
---|
192 | 192 | | credit score, rating, or other classification shall be the lowest eligible score, rating, |
---|
193 | 193 | | or other classification published in the underwriting guidelines. |
---|
194 | 194 | | 5. The applicant's minimum financial reserves, as determined by the authority, |
---|
195 | 195 | | after down payment and closing costs for the applicant's conventional mortgage for |
---|
196 | 196 | | the purchase of the residence subject to the workforce home loan satisfy the |
---|
197 | 197 | | underwriting guidelines. This subdivision does not apply if the payments on a |
---|
198 | 198 | | workforce home loan are deferred for at least 60 months. |
---|
199 | 199 | | 6. The applicant's conventional first mortgage for the purchase of the residence |
---|
200 | 200 | | subject to the workforce home loan is a fully amortizing, fixed-rate qualified |
---|
201 | 201 | | mortgage loan with a term of 30 or fewer years consistent with Regulation Z under |
---|
202 | 202 | | the federal Truth in Lending Act, 12 CFR 226. |
---|

240 | 240 | | (4) LOAN ISSUANCE; REPAYMENT. (a) 1. Subject to pars. (b) to (g), the authority |

241 | 241 | | may issue a loan to an eligible applicant certified by a qualified organization under |

242 | 242 | | sub. (3). |
---|
243 | 243 | | 2. The authority may not charge interest for any workforce home loan, and the |
---|
244 | 244 | | loan term shall be 30 years, except that in the case of applicants who qualify for |
---|
245 | 245 | | payment deferral under par. (f), the loan term shall be 40 years, and except that a |
---|
246 | 246 | | workforce home loan may be prepaid in whole or in part at any time without penalty. |

247 | 247 | | 3. No workforce home loan shall be forgivable in whole or in part. |

248 | 248 | | 4. Each workforce home loan shall be secured as a 2nd lien real estate |

249 | 249 | | mortgage. |

252 | 252 | | (b) The authority may issue a workforce home loan only for the purpose of |

---|
347 | 347 | | (b) The combined loan-to-value ratio, calculated using the sum of the amount |
---|
348 | 348 | | of the proposed new first mortgage loan and the outstanding balance of the workforce |
---|
349 | 349 | | home loan, divided by the fair market value of the subject property at the time of the |
---|
350 | 350 | | subordination request, as determined by the authority, is equal to or less than the |
---|
351 | 351 | | combined loan-to-value ratio at the time the workforce home loan was first issued, |
---|
352 | 352 | | calculated using the sum of the conventional first mortgage loan used to purchase |
---|
353 | 353 | | the residence and the amount of the original workforce home loan, divided by the |
---|
354 | 354 | | original fair market value of the subject property at the time the workforce home loan |
---|
355 | 355 | | was first issued. |

356 | 356 | | (c) The proposed new first mortgage loan is a fully amortizing, fixed-rate |
---|
357 | 357 | | qualified mortgage loan with a term of 30 or fewer years, consistent with Regulation |
---|
358 | 358 | | Z under the federal Truth in Lending Act, 12 CFR 226. |

359 | 359 | | (d) The workforce home loan recipient continues to satisfy sub. (3) (b) 3., 4., 5., |
