9	9	AN ACT to renumber and amend 117.01; to amend 16.967 (6) (a); and to create
10	10	16.967 (6) (c), 70.09 (2) (e), 115.28 (12), 117.01 (2) and 236.12 (2) (ar) of the
11	11	statutes; relating to: school district boundary adjustments for lots in newly
12	12	created subdivisions and requiring school district boundary mapping that is
13	13	compatible with the statewide digital map.
14	14	Analysis by the Legislative Reference Bureau
15	15	Current law requires that various state agencies annually submit to the
16	16	Department of Administration a plan to integrate land information so that the
17	17	information is readily available for use by any state, local governmental unit, or
18	18	public utility. Under current law, DOA must receive the land information integration
19	19	plans by March 31 of each year. Under the bill, the Department of Public Instruction
20	20	is also required to annually provide a land information integration plan.
21	21	The bill requires the land information officer of each county to annually submit
22	22	to DPI a digital mapping file of the boundaries of each school district in whole or in
23	23	part within the county. In addition, the real property lister of each county must
24	24	assign each lot in a subdivision created after the bill's effective date to the
25	25	appropriate school district and notify DPI of that assignment. Under the bill, if the
26	26	lot includes the boundary of two or more school districts, the real property lister must
27	27	assign the lot to the school district that encompasses more than 50 percent of the lot's
28	28	property. However, lots created by the subdivision platting process designated as
29	29	next phase or identified as for future development and being greater than five acres
30	30	are not subject to school district reassignment by the real property lister.

38	38	Finally, the state superintendent must annually publish and maintain a
39	39	statewide school district boundary layer that is compatible with the statewide digital
40	40	map maintained by DPI.
41	41	For further information see the state and local fiscal estimate, which will be
42	42	printed as an appendix to this bill.
43	43	The people of the state of Wisconsin, represented in senate and assembly, do
44	44	enact as follows:
45	45	SECTION 1. 16.967 (6) (a) of the statutes is amended to read:
46	46	16.967 (6) (a) By March 31 of each year, the department of administration, the
47	47	department of agriculture, trade and consumer protection, the department of safety
48	48	and professional services, the department of health services, the department of
49	49	natural resources, the department of tourism, the department of revenue, the
50	50	department of transportation, the department of public instruction, the board of
51	51	regents of the University of Wisconsin System, the public service commission, and
52	52	the board of curators of the historical society shall each submit to the department a
53	53	plan to integrate land information to enable such information to be readily
54	54	translatable, retrievable, and geographically referenced for use by any state, local
55	55	governmental unit, or public utility. Upon receipt of this information, the
56	56	department shall integrate the information to enable the information to be used to
57	57	meet land information data needs. The integrated information shall be readily
58	58	translatable, retrievable, and geographically referenced to enable members of the
59	59	public to use the information.
60	60	SECTION 2. 16.967 (6) (c) of the statutes is created to read:
61	61	16.967 (6) (c) No later than March 31, 2025, and no later than March 31 in each
62	62	year thereafter, the land information officer of each county shall submit to the
63	63	department of public instruction a digital mapping file of the boundaries of each

87	87	school district in whole or in part within the county, identified by the applicable
88	88	taxing jurisdictions in the most recent tax assessment year.
89	89	SECTION 3. 70.09 (2) (e) of the statutes is created to read:
90	90	70.09 (2) (e) To assign a lot in a subdivision, as defined in s. 236.02 (12), that
91	91	is created after the effective date of this paragraph .... [LRB inserts date], to the
92	92	appropriate school district and notify the department of public instruction of that
93	93	assignment. For purposes of this paragraph, if the lot includes the boundary of 2 or
94	94	more school districts, the real property lister shall assign the lot to the school district
95	95	that encompasses more than 50 percent of the lot's property. Those lots created by
96	96	the subdivision platting process designated as next phase or identified as for future
97	97	development and being greater than 5 acres are not subject to school district
98	98	reassignment as prescribed in this paragraph.
99	99	SECTION 4. 115.28 (12) of the statutes is created to read:
100	100	115.28 (12) SCHOOL DISTRICT BOUNDARIES; STATEWIDE DATA SET. (a) By March 1,
101	101	2025, and annually thereafter, publish and maintain a statewide school district
102	102	boundary layer that is compatible with the statewide digital map maintained by the
103	103	department of public instruction.
104	104	(b) Annually, beginning in the 2025-26 school year, submit the statewide school
105	105	district boundary layer to the U.S. bureau of the census.
106	106	SECTION 5. 117.01 of the statutes is renumbered 117.01 (intro.) and amended
107	107	to read:
108	108	117.01 Applicability. (intro.) This chapter does not apply to any of the
109	109	following:
110	110	(1) A school district reorganization affecting a school district operating under
111	111	ch. 119.

140	140	117.01 (2) A school district reorganization under s. 70.09 (2) (e).
141	141	SECTION 7. 236.12 (2) (ar) of the statutes is created to read:
142	142	236.12 (2) (ar) If a final plat includes a lot that may be assigned to a school
143	143	district by a real property lister under s. 70.09 (2) (e), within 2 days after the final
144	144	plat is submitted under par. (ac), the department shall transmit an electronic copy
145	145	of the plat, or, if the department prefers, 2 legible hard copies of the plat, to the clerk
146	146	of each school district included in the plat.
147	147	SECTION 8.0Nonstatutory provisions.
148	148	(1) INITIAL STATEWIDE SCHOOL DISTRICT BOUNDARY LAYER.
149	149	(a) By no later than the last day of the 3rd month beginning after the effective
150	150	date of this paragraph, each county land information officer shall submit to the
151	151	department of public instruction a digital mapping file that includes the boundaries
152	152	of each school district in the county that is consistent with how parcels were taxed
153	153	in the most recent tax assessment year.
154	154	(b) The department of public instruction shall identify any differences between
155	155	school district boundary maps maintained by the department and the mapping files
156	156	submitted by county land information officers under par. (a).
157	157	(c) By no later than the first day of the 13th month beginning after the effective
158	158	date of this paragraph, the department of public instruction, in coordination with
159	159	county real property listers and land information officers, shall confirm school
160	160	district boundaries in each county and prepare a statewide school district boundary
161	161	layer that is compatible with the statewide digital map maintained by the
162	162	department. The department shall submit the school district boundaries, as
