99 AN ACT to renumber and amend 117.01; to amend 16.967 (6) (a); and to create
1010 16.967 (6) (c), 70.09 (2) (e), 115.28 (12), 117.01 (2) and 236.12 (2) (ar) of the
1111 statutes; relating to: school district boundary adjustments for lots in newly
1212 created subdivisions and requiring school district boundary mapping that is
1313 compatible with the statewide digital map.
1414 Analysis by the Legislative Reference Bureau
1515 Current law requires that various state agencies annually submit to the
1616 Department of Administration a plan to integrate land information so that the
1717 information is readily available for use by any state, local governmental unit, or
1818 public utility. Under current law, DOA must receive the land information integration
1919 plans by March 31 of each year. Under the bill, the Department of Public Instruction
2020 is also required to annually provide a land information integration plan.
2121 The bill requires the land information officer of each county to annually submit
2222 to DPI a digital mapping file of the boundaries of each school district in whole or in
2323 part within the county. In addition, the real property lister of each county must
2424 assign each lot in a subdivision created after the bill's effective date to the
2525 appropriate school district and notify DPI of that assignment. Under the bill, if the
2626 lot includes the boundary of two or more school districts, the real property lister must
2727 assign the lot to the school district that encompasses more than 50 percent of the lot's
2828 property. However, lots created by the subdivision platting process designated as
2929 next phase or identified as for future development and being greater than five acres
3030 are not subject to school district reassignment by the real property lister.

3838 Finally, the state superintendent must annually publish and maintain a
3939 statewide school district boundary layer that is compatible with the statewide digital
4040 map maintained by DPI.
4141 For further information see the state and local fiscal estimate, which will be
4242 printed as an appendix to this bill.
4343 The people of the state of Wisconsin, represented in senate and assembly, do
4444 enact as follows:
4545 SECTION 1. 16.967 (6) (a) of the statutes is amended to read:
4646 16.967 (6) (a) By March 31 of each year, the department of administration, the
4747 department of agriculture, trade and consumer protection, the department of safety
4848 and professional services, the department of health services, the department of
4949 natural resources, the department of tourism, the department of revenue, the
5050 department of transportation, the department of public instruction, the board of
5151 regents of the University of Wisconsin System, the public service commission, and
5252 the board of curators of the historical society shall each submit to the department a
5353 plan to integrate land information to enable such information to be readily
5454 translatable, retrievable, and geographically referenced for use by any state, local
5555 governmental unit, or public utility. Upon receipt of this information, the
5656 department shall integrate the information to enable the information to be used to
5757 meet land information data needs. The integrated information shall be readily
5858 translatable, retrievable, and geographically referenced to enable members of the
5959 public to use the information.
6060 SECTION 2. 16.967 (6) (c) of the statutes is created to read:
6161 16.967 (6) (c) No later than March 31, 2025, and no later than March 31 in each
6262 year thereafter, the land information officer of each county shall submit to the
6363 department of public instruction a digital mapping file of the boundaries of each

8787 school district in whole or in part within the county, identified by the applicable
8888 taxing jurisdictions in the most recent tax assessment year.
8989 SECTION 3. 70.09 (2) (e) of the statutes is created to read:
9090 70.09 (2) (e) To assign a lot in a subdivision, as defined in s. 236.02 (12), that
9191 is created after the effective date of this paragraph .... [LRB inserts date], to the
9292 appropriate school district and notify the department of public instruction of that
9393 assignment. For purposes of this paragraph, if the lot includes the boundary of 2 or
9494 more school districts, the real property lister shall assign the lot to the school district
9595 that encompasses more than 50 percent of the lot's property. Those lots created by
9696 the subdivision platting process designated as next phase or identified as for future
9797 development and being greater than 5 acres are not subject to school district
9898 reassignment as prescribed in this paragraph.
9999 SECTION 4. 115.28 (12) of the statutes is created to read:
100100 115.28 (12) SCHOOL DISTRICT BOUNDARIES; STATEWIDE DATA SET. (a) By March 1,
101101 2025, and annually thereafter, publish and maintain a statewide school district
102102 boundary layer that is compatible with the statewide digital map maintained by the
103103 department of public instruction.
104104 (b) Annually, beginning in the 2025-26 school year, submit the statewide school
105105 district boundary layer to the U.S. bureau of the census.
106106 SECTION 5. 117.01 of the statutes is renumbered 117.01 (intro.) and amended
107107 to read:
108108 117.01 Applicability. (intro.) This chapter does not apply to any of the
109109 following:
110110 (1) A school district reorganization affecting a school district operating under
111111 ch. 119.

140140 117.01 (2) A school district reorganization under s. 70.09 (2) (e).
141141 SECTION 7. 236.12 (2) (ar) of the statutes is created to read:
142142 236.12 (2) (ar) If a final plat includes a lot that may be assigned to a school
143143 district by a real property lister under s. 70.09 (2) (e), within 2 days after the final
144144 plat is submitted under par. (ac), the department shall transmit an electronic copy
145145 of the plat, or, if the department prefers, 2 legible hard copies of the plat, to the clerk
146146 of each school district included in the plat.
147147 SECTION 8.0Nonstatutory provisions.
148148 (1) INITIAL STATEWIDE SCHOOL DISTRICT BOUNDARY LAYER.
149149 (a) By no later than the last day of the 3rd month beginning after the effective
150150 date of this paragraph, each county land information officer shall submit to the
151151 department of public instruction a digital mapping file that includes the boundaries
152152 of each school district in the county that is consistent with how parcels were taxed
153153 in the most recent tax assessment year.
154154 (b) The department of public instruction shall identify any differences between
155155 school district boundary maps maintained by the department and the mapping files
156156 submitted by county land information officers under par. (a).
157157 (c) By no later than the first day of the 13th month beginning after the effective
158158 date of this paragraph, the department of public instruction, in coordination with
159159 county real property listers and land information officers, shall confirm school
160160 district boundaries in each county and prepare a statewide school district boundary
161161 layer that is compatible with the statewide digital map maintained by the
162162 department. The department shall submit the school district boundaries, as
