| 14 | 14 | | (water pollutant discharge elimination system) permits and stormwater discharge |

| 15 | 15 | | permits. This bill requires a person who, as part of the person's activities under such |
|---|
| 16 | 16 | | a permit, creates a retention pond to install and maintain a fence around the |
|---|
| 17 | 17 | | perimeter of the retention pond and install signage that identifies the presence of the |
|---|
| 18 | 18 | | retention pond and warns of the dangers of entering the pond. |

| 19 | 19 | | The people of the state of Wisconsin, represented in senate and assembly, do |
|---|
| 20 | 20 | | enact as follows: |

| 21 | 21 | | SECTION 1. 283.56 of the statutes is created to read: |
|---|
| 22 | 22 | | 283.56 Fencing and signage of retention ponds. (1) In this section, |
|---|
| 23 | 23 | | “retention pond” means a temporary or permanent artificial water body designed to |
|---|
| 24 | 24 | | reduce the water quantity or water quality impacts of water received from a person |
|---|
| 25 | 25 | | holding a permit under this chapter for any period of time. “Retention pond” includes |

| 37 | 37 | | (2) Any person who is required to obtain a permit under this chapter and who, |

| 38 | 38 | | as part of the activities covered under the permit, creates or causes to be created a |

| 39 | 39 | | retention pond shall, as a condition of that permit, do all of the following: |

| 40 | 40 | | (a) Install and maintain fencing around the perimeter of the retention pond |

| 41 | 41 | | that is designed to keep individuals from entering the retention pond. |

| 42 | 42 | | (b) Install and maintain signage at the retention pond that clearly identifies |
|---|
| 43 | 43 | | the presence of the retention pond and notifies individuals of the dangers of entering |
