10	10	AN ACT to create 20.370 (6) (cs), 281.73 and 281.74 of the statutes; relating to:
11	11	grants for testing privately owned wells and providing education, providing an
12	12	exemption from emergency rule procedures, granting rule-making authority,
13	13	and making an appropriation.

15	15	This bill requires the Department of Natural Resources to create and
16	16	administer a program to provide two types of grants: 1) grants, not to exceed $10,000,
17	17	to any county and to any city, village, or town that contains privately owned wells or
18	18	water supplies to test and map privately owned wells to assess groundwater quality
19	19	and determine the extent of any contamination and to study and map geologic
20	20	characteristics and well construction practices to determine any correlation between
21	21	water quality, geology, and well construction; and 2) grants, not to exceed $10,000,
22	22	to county health departments and county land and water conservation departments
23	23	to provide education and outreach related to well testing. Applicants may apply for
24	24	a grant individually or jointly with other applicants and may apply for both types of
25	25	grants simultaneously. Under the bill, the recipient of a testing and mapping grant
26	26	must share the results of its testing with DNR and the University of
27	27	Wisconsin–Stevens Point Center for Watershed Science and Education but may not
28	28	include any personally identifiable information, including specific property
29	29	locations, with the submitted results.

36	36	The bill also requires cities, villages, and towns that contain privately owned
37	37	wells or water supplies to inform its residents of the importance of regular well
38	38	testing.
39	39	For further information see the state and local fiscal estimate, which will be
40	40	printed as an appendix to this bill.
41	41	The people of the state of Wisconsin, represented in senate and assembly, do
42	42	enact as follows:
43	43	SECTION 1. 20.005 (3) (schedule) of the statutes: at the appropriate place, insert
44	44	the following amounts for the purposes indicated:

50	50	SECTION 2. 20.370 (6) (cs) of the statutes is created to read:
51	51	20.370 (6) (cs) Environmental aids - private well testing grant program. From
52	52	the environmental fund, the amounts in the schedule to provide grants for testing
53	53	privately owned wells under s. 281.73.
54	54	SECTION 3. 281.73 of the statutes is created to read:
55	55	281.73 Private well testing grant program. (1) The department shall
56	56	administer a program to provide the following grants from the appropriation under
57	57	s. 20.370 (6) (cs):
58	58	(a) Grants to any county and to any city, village, or town that contains privately
59	59	owned wells or water supplies for the purpose of testing and mapping privately
60	60	owned wells to assess groundwater quality and to determine the extent and type of
61	61	any contamination and to study and map geologic characteristics and well

84	84	construction practices, including depth to bedrock and well age, to determine any
85	85	correlation between water quality, geology, and well construction. A grant provided
86	86	under this paragraph may not exceed $10,000.
87	87	(b) Grants to county health departments and county land and water
88	88	conservation departments for the purpose of providing education and outreach
89	89	related to well testing. A grant provided under this paragraph may not exceed
90	90	$10,000.
91	91	(2) Eligible applicants may apply for the grants under sub. (1) individually or
92	92	jointly with any other eligible applicant and may apply for the grants under sub. (1)
93	93	(a) and (b) simultaneously.
94	94	(3) The recipient of a grant under sub. (1) (a) shall submit the results of its
95	95	testing and study to the department and the University of Wisconsin–Stevens Point
96	96	Center for Watershed Science and Education but may not include any personally
97	97	identifiable information, including specific property locations, with the submitted
98	98	results.
99	99	(4) The department may promulgate rules to implement this section.
100	100	SECTION 4. 281.74 of the statutes is created to read:
101	101	281.74 Well testing importance. A city, village, or town that contains
102	102	privately owned wells or water supplies shall inform its residents of the importance
103	103	of regular well testing.
104	104	SECTION 5.0Nonstatutory provisions.
105	105	(1) 2025-27 BIENNIAL BUDGET REQUEST. In submitting information under s. 16.42
106	106	for purposes of the 2025-27 biennial budget bill, the department of natural resources
107	107	shall include a request to provide $2,000,000 in funding for fiscal year 2025-26 and

134	134	$2,000,000 in funding for fiscal year 2026-27 for the private well testing grant
135	135	program under s. 281.73.
136	136	(2) EMERGENCY RULES. The department of natural resources may use the
137	137	procedure under s. 227.24 to promulgate emergency rules relating to the private well
138	138	testing grant program under s. 281.73 for the period before the effective date of any
139	139	permanent rules promulgated under s. 281.73 but not to exceed the period
140	140	authorized under s. 227.24 (1) (c), subject to extension under s. 227.24 (2).
141	141	Notwithstanding s. 227.24 (1) (a), (2) (b), and (3), when promulgating emergency
142	142	rules under this subsection, the department is not required to provide evidence that
143	143	promulgating a rule under this subsection as an emergency rule is necessary for the
144	144	preservation of the public peace, health, safety, or welfare and is not required to
145	145	provide a finding of emergency for a rule promulgated under this subsection.
146	146	SECTION 6.0Effective date.
147	147	(1) This act takes effect on the day after publication, or on the 2nd day after
148	148	publication of the 2023 biennial budget act, whichever is later.
