10	10	AN ACT to amend 20.923 (15) (b) and 234.02 (3) of the statutes; relating to:
11	11	increasing the limit on compensation of the executive director and staff of
12	12	WHEDA.
13	13	Analysis by the Legislative Reference Bureau
14	14	Current law allows the Wisconsin Housing and Economic Development
15	15	Authority to employ an executive director and limits the compensation of the
16	16	executive director and employees of WHEDA to the maximum salary range
17	17	established for positions assigned to executive salary group 6. This bill increases the
18	18	limit on the compensation of the executive director and staff of WHEDA to 126.8
19	19	percent of the maximum salary range established for positions assigned to executive
20	20	salary group 6. The bill also allows WHEDA employees to receive pay that is equal
21	21	to or greater than the amount paid to the governor.
22	22	For further information see the state fiscal estimate, which will be printed as
23	23	an appendix to this bill.
24	24	The people of the state of Wisconsin, represented in senate and assembly, do
25	25	enact as follows:
26	26	SECTION 1. 20.923 (15) (b) of the statutes is amended to read:
27	27	20.923 (15) (b) Except for the positions identified in sub. (7) (b), positions
28	28	appointed or assigned under s. 234.02 (3), and positions approved by the joint

37	37	committee of employment relations, the pay of any incumbent whose salary is subject
38	38	to a limitation under this section may not equal or exceed that amount paid the
39	39	governor.
40	40	SECTION 2. 234.02 (3) of the statutes is amended to read:
41	41	234.02 (3) The governor shall appoint a public member as the chairperson of
42	42	the authority for a one-year term beginning on the expiration of the term of the
43	43	chairperson's predecessor. The authority shall elect a vice chairperson. The
44	44	governor shall nominate, and with the advice and consent of the senate appoint, the
45	45	executive director of the authority, to serve a 2-year term. The authority shall
46	46	employ the executive director so appointed, legal and technical experts and such
47	47	other officers, agents and employees, permanent and temporary, as it may require,
48	48	and shall determine their qualifications, duties and compensation, all
49	49	notwithstanding subch. II of ch. 230, except that s. 230.40 shall apply, and except
50	50	that the compensation of any employee of the authority shall not exceed 126.8
51	51	percent of the maximum of the executive salary group range established under s.
52	52	20.923 (1) for positions assigned to executive salary group 6. The authority may
53	53	delegate any of its powers or duties to its employees with the consent of the executive
54	54	director or to its agents.
