1212 AN ACT to create 632.895 (17) (b) 3. of the statutes; relating to: requiring
1313 coverage of the dispensing of an extended supply of contraceptives.

1515 This bill requires certain health insurance policies, known in the statutes as
1616 disability insurance policies, and self-insured governmental and school district
1717 health plans to cover a dispensing of contraceptives that is intended to last for three
1818 months for the first dispensing and a dispensing of contraceptives that is intended
1919 to last for 12 months for subsequent dispensings of that contraceptive.
2020 Contraceptives are drugs or devices approved by the federal Food and Drug
2121 Administration to prevent pregnancy. Under current law, those policies and plans
2222 must cover the cost of contraceptives prescribed by a health care provider and of
2323 services that are necessary to prescribe, administer, maintain, or remove the
2424 contraceptive. The coverage requirement under the bill does not apply to a
2525 dispensing of a contraceptive that expires or becomes ineffective in less than 12
2626 months.
2727 The people of the state of Wisconsin, represented in senate and assembly, do
2828 enact as follows:
2929 SECTION 1. 632.895 (17) (b) 3. of the statutes is created to read:
3030 632.895 (17) (b) 3. A dispensing of contraceptives under subd. 1. that is
3131 intended to last for a 3-month period for the first dispensing of the contraceptive to

3939 an insured and a dispensing of contraceptives that is intended to last for a 12-month
4040 period for subsequent dispensings of the same contraceptive to the insured,
4141 regardless of whether the insured was insured under that policy or plan at the time
4242 of the first dispensing. This subdivision does not apply to a dispensing of a
4343 contraceptive that expires or becomes ineffective in less than 12 months from the
4444 date of dispensing.
4545 SECTION 2.0Initial applicability.
4646 (1) EXTENDED SUPPLY OF CONTRACEPTIVES.
4747 (a) For policies and plans containing provisions inconsistent with this act, the
4848 act first applies to policy or plan years beginning on January 1 of the year following
4949 the year in which this paragraph takes effect, except as provided in par. (b).
5050 (b) For policies or plans that are affected by a collective bargaining agreement
5151 containing provisions inconsistent with this act, this act first applies to policy or plan
5252 years beginning on the effective date of this paragraph or on the day on which the
5353 collective bargaining agreement is newly established, extended, modified, or
5454 renewed, whichever is later.
