8	8	AN ACT to create 20.455 (2) (cs) and 165.985 of the statutes; relating to: law
9	9	enforcement agency third-party accreditation award program and making an
10	10	appropriation.
11	11	Analysis by the Legislative Reference Bureau
12	12	This bill requires the Department of Justice to establish an award program that
13	13	provides awards on a first-come, first-served basis to law enforcement agencies that
14	14	have gone through an approved third-party accreditation process. Under the bill,
15	15	there are two tiers of award funding available: the higher tier of funding provides
16	16	$25,000 to law enforcement agencies that have received full state or national
17	17	accreditation and the lower tier of funding provides $8,000 to law enforcement
18	18	agencies that have received core or partial state or national accreditation. Under the
19	19	bill, a law enforcement agency may receive an award once every three years.
20	20	The bill provides $792,200 in the 2023-24 fiscal year and $1,042,200 in the
21	21	2024-25 fiscal year for this purpose and increases the authorized full-time
22	22	equivalent positions for DOJ by one position to administer the award program
23	23	created in the bill.

26	26	The people of the state of Wisconsin, represented in senate and assembly, do
27	27	enact as follows:

33	33	SECTION 1. 20.005 (3) (schedule) of the statutes: at the appropriate place, insert
34	34	the following amounts for the purposes indicated:

41	41	SECTION 2. 20.455 (2) (cs) of the statutes is created to read:
42	42	20.455 (2) (cs) Law enforcement agency 3rd-party accreditation award
43	43	program. The amounts in the schedule to provide awards to Wisconsin law
44	44	enforcement agencies under s. 165.985 (2).
45	45	SECTION 3. 165.985 of the statutes is created to read:
46	46	165.985 Law enforcement agency 3rd-party accreditation award
47	47	program. (1) In this section:
48	48	(a) “Third-party accreditation” means a process in which a professional
49	49	accreditation entity that has been approved by the department of justice under sub.
50	50	(5) conducts an independent review and evaluation of law enforcement agency
51	51	operations and compliance with prescribed standards.
52	52	(b) “Wisconsin law enforcement agency" means a governmental unit of one or
53	53	more persons employed full time by this state or a political subdivision of this state
54	54	for the purpose of preventing and detecting crime and enforcing state laws or local
55	55	ordinances, employees of which unit are authorized to make arrests for crimes while
56	56	acting within the scope of their authority.

84	84	(2) From the appropriation under s. 20.455 (2) (cs), the department of justice
85	85	shall provide awards to Wisconsin law enforcement agencies to fund law
86	86	enforcement agency 3rd-party accreditation. The department of justice may issue
87	87	an award under this subsection to a Wisconsin law enforcement agency after the
88	88	Wisconsin law enforcement agency has successfully completed an accreditation or
89	89	reaccreditation process. The department of justice shall issue awards under this
90	90	subsection in the order in which award applications are received. The department
91	91	of justice may establish additional criteria and procedures for the distribution of
92	92	awards under this subsection. Notwithstanding s. 227.10 (1), the department of
93	93	justice need not promulgate the criteria and procedures as rules under ch. 227.
94	94	(3) Awards under sub. (2) shall be in the following amounts:
95	95	(a) For a Wisconsin law enforcement agency that is fully accredited as meeting
96	96	state or national law enforcement standards, $25,000.
97	97	(b) For a Wisconsin law enforcement agency that is core accredited or partially
98	98	accredited as meeting state or national law enforcement standards, $8,000.
99	99	(4) A Wisconsin law enforcement agency may receive an award under sub. (2)
100	100	once every 3 years, after successful completion of the accreditation or reaccreditation
101	101	process.
102	102	(5) The department of justice shall identify and publish a list of approved
103	103	professional accreditation entities.
104	104	SECTION 4.0Fiscal changes.
105	105	(1) LAW ENFORCEMENT AGENCY 3RD-PARTY ACCREDITATION AWARD PROGRAM
106	106	ADMINISTRATION. In the schedule under s. 20.005 (3) for the appropriation to the
107	107	department of justice under s. 20.455 (2) (a), the dollar amount for fiscal year
108	108	2023-24 is increased by $127,200 to increase the authorized FTE positions for the

137	137	accreditation award program. In the schedule under s. 20.005 (3) for the
138	138	appropriation to the department of justice under s. 20.455 (2) (a), the dollar amount
139	139	for fiscal year 2024-25 is increased by $127,200 to provide funding for the position
140	140	authorized under this subsection.
