9 | 9 | | AN ACT to create 125.51 (4) (w) 6. of the statutes; relating to: allowing towns |
---|
10 | 10 | | to exceed their retail liquor license quota by issuing one additional retail |
---|
11 | 11 | | license. |
---|
12 | 12 | | Analysis by the Legislative Reference Bureau |
---|
13 | 13 | | This bill creates a liquor license quota exception under which each town may |
---|
14 | 14 | | issue one additional liquor license. |
---|
15 | 15 | | Current law prohibits a person from selling alcohol beverages at retail unless |
---|
16 | 16 | | the seller possesses a license or permit authorizing the sale. A “Class B" license |
---|
17 | 17 | | authorizes the retail sale of intoxicating liquor for consumption on the retail |
---|
18 | 18 | | premises and, subject to various restrictions, the retail sale of intoxicating liquor for |
---|
19 | 19 | | consumption off the retail premises. Current law imposes a quota on the number of |
---|
20 | 20 | | “Class B" licenses that a municipality may issue. This quota is generally determined |
---|
21 | 21 | | by a formula based on the number of licenses previously issued by the municipality |
---|
22 | 22 | | and the municipality's population. Current law also provides a limited number of |
---|
23 | 23 | | quota exceptions. |
---|
24 | 24 | | The bill allows each town in this state to issue one “Class B" license in addition |
---|
25 | 25 | | to the “Class B" licenses authorized under the town's quota. |
