10	10	AN ACT to amend 632.895 (17) (b) 2. of the statutes; relating to: coverage of
11	11	sterilization procedures and patient education and counseling under health
12	12	insurance policies and plans.
13	13	Analysis by the Legislative Reference Bureau
14	14	Under current law, health insurance policies and self-insured governmental
15	15	health plans that provide coverage of outpatient health care services, preventive
16	16	treatments and services, or prescription drugs and devices are required to provide
17	17	coverage of certain contraceptives and related services, including outpatient
18	18	consultations, examinations, procedures, and medical services that are necessary to
19	19	prescribe, administer, maintain, or remove a contraceptive. This bill requires that
20	20	health insurance policies and self-insured governmental health plans that are
21	21	required to provide such contraceptive coverage under current law also provide
22	22	coverage for sterilization procedures and patient education and counseling. Health
23	23	insurance policies are referred to in the statutes as disability insurance policies.
24	24	This proposal may contain a health insurance mandate requiring a social and
25	25	financial impact report under s. 601.423, stats.

27	27	an appendix to this bill.
28	28	The people of the state of Wisconsin, represented in senate and assembly, do
29	29	enact as follows:

35	35	SECTION 1. 632.895 (17) (b) 2. of the statutes is amended to read:
36	36	632.895 (17) (b) 2. Outpatient consultations, examinations, procedures, and
37	37	medical services that are necessary to prescribe, administer, maintain, or remove a
38	38	contraceptive, if covered for any other drug benefits under the policy or plan
39	39	sterilization procedures, and patient education and counseling.
40	40	SECTION 2.0Initial applicability.
41	41	(1) For policies and plans containing provisions inconsistent with this act, this
42	42	act first applies to policy or plan years beginning on the effective date of this
43	43	subsection, except as provided in sub. (2).
44	44	(2) For policies and plans that are affected by a collective bargaining agreement
45	45	containing provisions inconsistent with this act, this act first applies to policy or plan
46	46	years beginning on the effective date of this subsection or on the day on which the
47	47	collective bargaining agreement is newly established, extended, modified, or
48	48	renewed, whichever is later.
49	49	SECTION 3.0Effective date.
50	50	(1) This act takes effect on the first day of the 4th month beginning after
51	51	publication.
