1010 AN ACT to amend 632.895 (17) (b) 2. of the statutes; relating to: coverage of
1111 sterilization procedures and patient education and counseling under health
1212 insurance policies and plans.
1313 Analysis by the Legislative Reference Bureau
1414 Under current law, health insurance policies and self-insured governmental
1515 health plans that provide coverage of outpatient health care services, preventive
1616 treatments and services, or prescription drugs and devices are required to provide
1717 coverage of certain contraceptives and related services, including outpatient
1818 consultations, examinations, procedures, and medical services that are necessary to
1919 prescribe, administer, maintain, or remove a contraceptive. This bill requires that
2020 health insurance policies and self-insured governmental health plans that are
2121 required to provide such contraceptive coverage under current law also provide
2222 coverage for sterilization procedures and patient education and counseling. Health
2323 insurance policies are referred to in the statutes as disability insurance policies.
2424 This proposal may contain a health insurance mandate requiring a social and
2525 financial impact report under s. 601.423, stats.
2626 For further information see the state fiscal estimate, which will be printed as
2727 an appendix to this bill.
2828 The people of the state of Wisconsin, represented in senate and assembly, do
2929 enact as follows:

3535 SECTION 1. 632.895 (17) (b) 2. of the statutes is amended to read:
3636 632.895 (17) (b) 2. Outpatient consultations, examinations, procedures, and
3737 medical services that are necessary to prescribe, administer, maintain, or remove a
3838 contraceptive, if covered for any other drug benefits under the policy or plan
3939 sterilization procedures, and patient education and counseling.
4040 SECTION 2.0Initial applicability.
4141 (1) For policies and plans containing provisions inconsistent with this act, this
4242 act first applies to policy or plan years beginning on the effective date of this
4343 subsection, except as provided in sub. (2).
4444 (2) For policies and plans that are affected by a collective bargaining agreement
4545 containing provisions inconsistent with this act, this act first applies to policy or plan
4646 years beginning on the effective date of this subsection or on the day on which the
4747 collective bargaining agreement is newly established, extended, modified, or
4848 renewed, whichever is later.
4949 SECTION 3.0Effective date.
5050 (1) This act takes effect on the first day of the 4th month beginning after
5151 publication.
