17 | 17 | | Under current law, municipal employees who are public safety employees, such |
---|
18 | 18 | | as police officers, fire fighters, and emergency medical service providers for |
---|
19 | 19 | | emergency medical services departments, may bargain collectively over wages, |
---|
20 | 20 | | hours, and conditions of employment. Public safety employees, however, may not |
---|
21 | 21 | | bargain over a subject that is identified as a prohibited subject of bargaining. Under |
---|
22 | 22 | | current law, all costs and payments associated with health care coverage plans and |
---|
23 | 23 | | the design and selection of health care coverage plans by a municipal employer for |
---|
24 | 24 | | public safety employees, as well as the impact of the costs and payments and the |
---|
25 | 25 | | design and selection of the plans on wages, hours, and conditions of employment of |
---|
26 | 26 | | public safety employees, are prohibited subjects of bargaining for public safety |
---|
27 | 27 | | employees. |
---|
28 | 28 | | This bill clarifies that for purposes of the prohibition against bargaining over |
---|
29 | 29 | | the design of a health care coverage plan selected by a municipal employer, design |
---|
30 | 30 | | does not include who is covered by the health care coverage plan. In other words, |
---|
31 | 31 | | public safety employees may bargain with a municipal employer about who will be |
---|
32 | 32 | | covered by a health care coverage plan selected by the municipal employer. In |
---|
33 | 33 | | addition, this bill clarifies that the initial decision of whether or not to provide health |
---|
34 | 34 | | care coverage is a permitted subject of bargaining between a municipal employer and |
---|
35 | 35 | | public safety employees. |

42 | 42 | | The people of the state of Wisconsin, represented in senate and assembly, do |

43 | 43 | | enact as follows: |

44 | 44 | | SECTION 1. 111.70 (4) (mc) 6. of the statutes is amended to read: |

45 | 45 | | 111.70 (4) (mc) 6. Except for whether or not to provide health care coverage and |
---|
46 | 46 | | the employee premium contribution, all costs and payments associated with health |
---|
47 | 47 | | care coverage plans and the design and selection of health care coverage plans by the |
---|
48 | 48 | | municipal employer for public safety employees, and the impact of such costs and |
---|
49 | 49 | | payments and the design and selection of the health care coverage plans on the |
---|
50 | 50 | | wages, hours, and conditions of employment of the public safety employee. For |
---|
51 | 51 | | purposes of this subdivision, “design” does not include the decision as to who is |
---|
52 | 52 | | covered by a health care coverage plan selected by the municipal employer. |

53 | 53 | | SECTION 2.0Nonstatutory provisions. |
---|
54 | 54 | | (1) LEGISLATIVE INTENT STATEMENT. The legislature intends that the treatment |
---|
55 | 55 | | of s. 111.70 (4) (mc) 6. by this act is to clarify the intent of 2011 Wisconsin Acts 10 and |
---|
56 | 56 | | 32 and that this act is to be considered a restatement of current law. |
