14 | 14 | | This bill requires the use of carbon monoxide detectors in child care centers and |
---|
15 | 15 | | public and private elementary and secondary schools that are served by a |
---|
16 | 16 | | fuel-burning forced-air furnace or a boiler. The bill also requires owners of child care |
---|
17 | 17 | | centers and public and private elementary and secondary schools to reasonably |
---|
18 | 18 | | maintain all carbon monoxide detectors as specified in the detectors' instructions. |
---|
19 | 19 | | Under current law generally, carbon monoxide detectors are required in |
---|
20 | 20 | | dwellings with an attached garage, a fireplace, or a fuel-burning appliance. Carbon |
---|
21 | 21 | | monoxide detectors are also required in public buildings that are used for sleeping |
---|
22 | 22 | | or lodging purposes and contain a fuel-burning appliance, a fuel-burning forced-air |
---|
23 | 23 | | furnace, or an attached garage. |
---|

26 | 26 | | The people of the state of Wisconsin, represented in senate and assembly, do |

28 | 28 | | SECTION 1. 101.149 (1) (aj) of the statutes is created to read: |

35 | 35 | | 101.149 (1) (aj) “Boiler” means a fossil fuel or carbon-based fuel-fired boiler |
---|
36 | 36 | | that produces carbon monoxide as a combustion by-product. |
---|
37 | 37 | | SECTION 2. 101.149 (2) (b) of the statutes is created to read: |

38 | 38 | | 101.149 (2) (b) Elementary and secondary schools and child care centers. |
---|
39 | 39 | | Carbon monoxide detectors shall be provided in public and private elementary and |
---|
40 | 40 | | secondary schools and in child care centers licensed under s. 48.65 that are served |
---|
41 | 41 | | by a fuel-burning, forced-air furnace or a boiler. Carbon monoxide detectors shall |
---|
42 | 42 | | be installed in each room containing a fuel-burning, forced-air furnace or a boiler. |
---|
43 | 43 | | SECTION 3. 101.149 (3) (a) of the statutes is amended to read: |
---|
44 | 44 | | 101.149 (3) (a) The owner of a residential building or building described in par. |
---|
45 | 45 | | (b) shall reasonably maintain every carbon monoxide detector in the residential |
---|
46 | 46 | | building in the manner specified in the instructions for the carbon monoxide detector. |
---|
47 | 47 | | SECTION 4. 101.149 (3) (am) of the statutes is amended to read: |
---|
48 | 48 | | 101.149 (3) (am) If any person certified under s. 101.12 (4) or 101.14 (4r) gives |
---|
49 | 49 | | written notice to an owner of a residential building or building described in par. (b) |
---|
50 | 50 | | that a carbon monoxide detector in the residential building is not functional, the |
---|
51 | 51 | | owner shall provide, within 5 days after receipt of that notice, any maintenance |
---|
52 | 52 | | necessary to make that carbon monoxide detector functional. |
---|
53 | 53 | | SECTION 5. 101.149 (7) of the statutes is amended to read: |
---|
54 | 54 | | 101.149 (7) INSPECTION. To ensure compliance with subs. (2) and (3), the |
---|
55 | 55 | | department or a person certified under s. 101.12 (4) or 101.14 (4r) may inspect |
---|
56 | 56 | | buildings described in par. (b), may inspect the common area of residential buildings, |
---|
57 | 57 | | and may inspect a unit within such buildings a residential building at the request |
---|
58 | 58 | | of the owner or occupant of the unit to be inspected. |
---|
59 | 59 | | SECTION 6.0Effective date. |
