12 | 12 | | Under current law, state employees are generally entitled to receive paid sick |
---|
13 | 13 | | leave as part of their compensation, and, if an employee does not use all of his or her |
---|
14 | 14 | | sick leave during a calendar year, the employee may accumulate unused sick leave |
---|
15 | 15 | | from year to year in a sick leave account. The paid sick leave for state employees is |
---|
16 | 16 | | regulated by administrative rules of the division of personnel management in the |
---|
17 | 17 | | department of administration. |
---|
18 | 18 | | Under this bill, a state employee who is a veteran of the U.S. armed forces or |
---|
19 | 19 | | in forces incorporated as part of the U.S. armed forces during a war period or in a |
---|
20 | 20 | | crisis zone is entitled to 60 hours per year of paid sick leave in order to receive health |
---|
21 | 21 | | care or mental health care for a disability related to the employee's military service |
---|
22 | 22 | | at a facility operated by the U.S. Department of Veterans Affairs or at a facility to |
---|
23 | 23 | | which a veteran is referred for treatment under the U.S. Department of Veterans |
---|
24 | 24 | | Affairs Community Care Network. This paid leave is in addition to any paid sick |
---|
25 | 25 | | leave generally provided to state employees and does not accumulate from year to |
---|
26 | 26 | | year and may not be converted to credits to pay for health insurance in retirement. |

35 | 35 | | SECTION 1. 230.35 (2g) of the statutes is created to read: |

36 | 36 | | 230.35 (2g) (a) In this subsection: |

37 | 37 | | 1. “Health care” has the meaning given in s. 155.01 (3). |

38 | 38 | | 2. “Veteran” has the meaning given in s. 45.01 (12) (a) to (f). |

39 | 39 | | (b) An appointing authority shall grant a leave of absence with pay owing to |
---|
40 | 40 | | sickness of at least 60 hours per year for any veteran employed by the appointing |
---|
41 | 41 | | authority, for the employee to receive health care or mental health care for a |
---|
42 | 42 | | disability related to the employee's military service at any facility operated by the |
---|
43 | 43 | | U.S. department of veterans affairs or at a facility to which a veteran is referred for |
---|
44 | 44 | | treatment under the U.S. department of veterans affairs community care network, |
---|
45 | 45 | | if that care is on behalf of and paid for by the U.S. department of veterans affairs. |

46 | 46 | | Leave under this subsection is in addition to any leave under sub. (2) and does not |
---|
47 | 47 | | accumulate from year to year and may not be converted to credits to pay for health |
---|
48 | 48 | | insurance under s. 40.05 (4) (b), (bc), or (bf) or the supplemental health insurance |
---|
49 | 49 | | conversion credit program under s. 230.12 (9). The administrator shall promulgate |
---|
50 | 50 | | rules to implement this subsection. |
