14 | 14 | | This bill requires the Department of Agriculture, Trade and Consumer |
---|
15 | 15 | | Protection to develop and maintain a list of ingredients with certain human and |
---|
16 | 16 | | environmental effects, including ingredients that are carcinogenic, cause |
---|
17 | 17 | | reproductive or developmental toxicity, or are fragrance allergens. A manufacturer |
---|
18 | 18 | | of a menstrual product sold or distributed in the state must disclose to DATCP any |
---|
19 | 19 | | ingredient in the menstrual product that is included in the list developed by DATCP. |
---|
20 | 20 | | DATCP must post the same information about the menstrual product's ingredients |
---|
21 | 21 | | on its website, in an easily readable format, along with the health hazards associated |
---|
22 | 22 | | with each ingredient. |
---|
23 | 23 | | The bill also prohibits a person from selling or offering for sale a menstrual |
---|
24 | 24 | | product package unless it is labeled with all of the contained menstrual product's |
---|
25 | 25 | | ingredients, including any ingredients included in the list developed or maintained |
---|
26 | 26 | | by DATCP. The ingredients must be listed in order of descending weight and using |
---|
27 | 27 | | the ingredient's common name or standardized nomenclature. |

35 | 35 | | The people of the state of Wisconsin, represented in senate and assembly, do |
---|
36 | 36 | | enact as follows: |

37 | 37 | | SECTION 1. 100.298 of the statutes is created to read: |
---|
38 | 38 | | 100.298 Menstrual product ingredient disclosure. (1) DEFINITIONS. In |
---|
39 | 39 | | this section: |
---|
40 | 40 | | (a) “Fragrance ingredient” means an intentionally added substance or complex |
---|
41 | 41 | | mixture of aroma chemicals, natural essential oils, and other functional ingredients |
---|
42 | 42 | | present in a menstrual product for which the sole purpose is to impart an odor or |
---|
43 | 43 | | scent or to counteract odor. |
---|
44 | 44 | | (b) “Ingredient” means a fragrance ingredient or other intentionally added |
---|
45 | 45 | | substance or combination of substances present in a menstrual product. |
---|
46 | 46 | | (c) “Intentionally added” means a substance that serves a technical or |
---|
47 | 47 | | functional purpose in a finished menstrual product. |
---|
48 | 48 | | (d) “Manufacturer” means one of the following: |
---|
49 | 49 | | 1. A person that manufactures a menstrual product and whose name appears |
---|
50 | 50 | | on the product label. |
---|
51 | 51 | | 2. A person for whom the menstrual product is manufactured or distributed, |
---|
52 | 52 | | as identified on the product label pursuant to the federal Fair Packaging and Label |
---|
53 | 53 | | Act, 15 USC 1451, et seq. |
---|
54 | 54 | | (e) “Menstrual product” means a product used to collect menstruation and |
---|
55 | 55 | | vaginal discharge, including tampons, pads, sponges, menstruation underwear, |
---|
56 | 56 | | disks, and menstrual cups, whether disposable or reusable. |

81 | 81 | | (2) LIST OF INGREDIENTS. The department shall develop and maintain a list of |
---|
82 | 82 | | ingredients that are any of the following: |
---|
83 | 83 | | (a) Known or likely to cause cancer in humans. |
---|
84 | 84 | | (b) Known to cause reproductive or developmental toxicity in humans. |
---|
85 | 85 | | (c) Mutagens. |
---|
86 | 86 | | (d) Endocrine disrupting. |
---|
87 | 87 | | (e) Persistent, bioaccumulative, and toxic. |
---|
88 | 88 | | (f) Respiratory sensitizers. |
---|
89 | 89 | | (g) Neurotoxicants. |
---|
90 | 90 | | (h) Toxic air contaminants. |
---|
91 | 91 | | (i) Fragrance allergens. |
---|
92 | 92 | | (3) REQUIRED MANUFACTURER DISCLOSURE. A manufacturer of a menstrual |
---|
93 | 93 | | product sold or distributed in the state shall disclose to the department any |
---|
94 | 94 | | ingredient present in the menstrual product that is included in the list under sub. |
---|
95 | 95 | | (2). A manufacturer shall disclose to the department any change to the ingredients |
---|
96 | 96 | | of a menstrual product no later than one month after the change of the ingredients. |
---|
97 | 97 | | (4) REQUIRED MANUFACTURER WEBSITE POSTING. A manufacturer of a menstrual |
---|
98 | 98 | | product sold or distributed in the state shall post on its website in an electronically |
---|
99 | 99 | | readable format the ingredient information required to be labeled on the menstrual |
---|
100 | 100 | | product package under s. 100.299 (2). If a menstrual product's ingredient |
---|
101 | 101 | | information changes, the manufacturer of the menstrual product shall revise its |
---|
102 | 102 | | website posting required under this subsection with the updated menstrual product |
---|
103 | 103 | | ingredient information no later than 6 months after the change of ingredient |
---|
104 | 104 | | information unless a later effective date for the revision is approved by the |
---|

139 | 139 | | SECTION 2. 100.299 of the statutes is created to read: |

140 | 140 | | 100.299 Labeling of menstrual product ingredients. (1) DEFINITIONS. In |

142 | 142 | | (a) “Menstrual product” has the meaning under s. 100.298 (1) (e). |
---|
143 | 143 | | (b) “Menstrual product package” means a container in which a menstrual |
---|
144 | 144 | | product is enclosed for retail sale. |
---|
145 | 145 | | (2) PROHIBITED SALE UNLESS LABELED. (a) No person may sell or offer for sale |
---|
146 | 146 | | a menstrual product package unless it is conspicuously labeled with an accurate list |
---|
147 | 147 | | of all the ingredients present in the menstrual product, including any ingredients |
---|
148 | 148 | | included in a list developed or maintained by the department under s. 100.298. The |
---|
149 | 149 | | labelling required under this paragraph shall list all of the ingredients of the |
---|
150 | 150 | | menstrual product in order of predominance by weight, except that ingredients |
---|
151 | 151 | | present at a weight below one percent may be listed in any order following the |
---|
152 | 152 | | ingredients that are present at a weight at or above one percent. The labelling |
---|
153 | 153 | | required under this paragraph shall list all ingredients using the common chemical |
---|
154 | 154 | | name of the ingredient, the name for the ingredient established by the Center for |
---|
155 | 155 | | Baby and Adult Hygiene Products, or standardized nomenclature for the ingredient |
---|
156 | 156 | | including that from the International Nomenclature of Cosmetic Ingredients or the |
