2023 ASSEMBLY BILL 161 
2023 Assembly Bill 161 creates an appropriation to make payments from the ambulance service 
provider trust fund to eligible ambulance service providers as specified under 2021 Wisconsin Act 228.  
Act 228 created new programs to facilitate supplemental reimbursements under the Medical Assistance 
(MA) program for both privately owned and public ambulance services. Specific to private ambulance 
providers, Act 228 created a provider assessment with fees collected going to an ambulance service 
provider trust fund. Act 228 also directed the state Department of Health Services (DHS) to seek any 
federal approval needed to implement this new component of the state Medicaid program. 
In addition to creating the trust fund appropriation account, the bill requires DHS to begin making 
payments to eligible ambulance service providers within 60 days of federal approval. The bill also 
requires the Department of Administration to transfer money annually from the ambulance service 
provider trust fund to cover the administrative costs associated with administering the ambulance 
assessment and making supplemental reimbursements to ambulance providers. 
ASSEMBLY AMENDMENT 1 
Assembly Amendment 1 eliminates the requirement that DHS begin making payments to eligible 
ambulance service providers within 60 days of federal approval.
