10	10	animal-drawn vehicles.

12	12	Current law allows a county, town, village, or city to enact an ordinance to
13	13	collect an annual registration fee for motor vehicles that weigh less than 8,000
14	14	pounds and are customarily kept in the county, town, village, or city.
15	15	This bill allows a county to enact an ordinance requiring registration of, and
16	16	imposing an annual flat registration fee not to exceed $100 on, animal-drawn
17	17	vehicles that are operated on a highway and customarily kept in the county. The
18	18	ordinance, however, may not require the registration of animal-drawn vehicles that
19	19	are used solely for recreational purposes or that are implements of husbandry. The
20	20	bill requires a county to pay 50 percent of any such fee to a town in which the vehicle
21	21	is customarily kept. The registration fee moneys may be used only for transportation
22	22	purposes or for actual administrative costs related to the collection of the registration
23	23	fee.

26	26	The people of the state of Wisconsin, represented in senate and assembly, do
27	27	enact as follows:
28	28	SECTION 1. 59.58 (6) of the statutes is created to read:

34	34	59.58 (6) REGISTRATION OF ANIMAL-DRAWN VEHICLES. (a) Except as provided in
35	35	this paragraph, the board may enact an ordinance requiring registration of, and
36	36	imposing an annual flat registration fee not to exceed $100 on, animal-drawn
37	37	vehicles that are operated on a highway and customarily kept in the county. If an
38	38	animal-drawn vehicle is customarily kept in more than one county, a county may not
39	39	require registration or impose a registration fee if the vehicle has been registered in
40	40	a county in which the vehicle is customarily more often kept. An ordinance under
41	41	this paragraph may require that proof of registration be displayed on or carried with
42	42	the registered vehicle. An ordinance under this paragraph may not require the
43	43	registration of an animal-drawn vehicle that is used solely for recreational purposes,
44	44	including use in a parade, or that is an implement of husbandry, as defined in s.
45	45	340.01 (24).
46	46	(b) If a vehicle that is subject to a fee under an ordinance enacted under par.
47	47	(a) is customarily kept in a town, the board shall pay 50 percent of the fee to that
48	48	town.
49	49	(c) Registration fees collected under an ordinance enacted under par. (a) or paid
50	50	under par. (b) may be used only for transportation purposes or for actual
51	51	administrative costs related to the collection of the fees.
52	52	(d) No registration fee that is imposed under an ordinance enacted under par.
53	53	(a) may be imposed on an animal-drawn vehicle that is a replacement for an
54	54	animal-drawn vehicle for which a current registration fee has been paid.
