11	11	AN ACT to create 20.932 of the statutes; relating to: state and local
12	12	governmental use of certain mobile or online software applications and
13	13	electronic devices.

15	15	Under this bill, no official, employee, or contractor of a state agency or local
16	16	governmental unit, other than a law enforcement officer for law enforcement
17	17	purposes, may access or use a mobile or online software application prohibited under
18	18	the bill, as specified below, using an electronic device that is owned, operated, or
19	19	leased by a state agency or local governmental unit. Additionally, the bill prohibits
20	20	any state agency or local governmental unit from owning, operating, or leasing any
21	21	electronic device prohibited under the bill.
22	22	The bill provides that all of the following mobile or online software applications
23	23	and their successor applications and all mobile or online software applications and
24	24	all electronic devices manufactured, developed, owned, or provided by the following
25	25	entities, or a parent, subsidiary, or successor of the entity, are prohibited software
26	26	applications and devices:
27	27	1. TikTok.
28	28	2. ByteDance Limited.
29	29	3. Huawei Technologies.
30	30	4. ZTE Corporation.
31	31	5. Hytera Communications Corporation.
32	32	6. Hangzhou Hikvision Digital Technology Company.

46	46	The people of the state of Wisconsin, represented in senate and assembly, do
47	47	enact as follows:
48	48	SECTION 1. 20.932 of the statutes is created to read:
49	49	20.932 Ban on mobile or online software applications and electronic
50	50	devices deemed cybersecurity threats. (1) DEFINITIONS. In this section:
51	51	(a) “Local governmental unit" means a political subdivision, a special purpose
52	52	district, an agency or corporation of a political subdivision or special purpose district,
53	53	a school district, or a combination or subunit of any of the foregoing, in this state.
54	54	(b) “State agency" means an association, authority, board, department,
55	55	commission, independent agency, institution, system, office, society, or other body in
56	56	state government created or authorized to be created by the constitution or any law.
57	57	(2) BAN. (a) No official, employee, or contractor of a state agency or local
58	58	governmental unit, other than a law enforcement officer, as defined in s. 967.02 (5),
59	59	for law enforcement purposes, may access or use a mobile or online software
60	60	application prohibited under sub. (3) using an electronic device that is owned,
61	61	operated, or leased by a state agency or local governmental unit.
62	62	(b) No state agency or local governmental unit may own, operate, or lease any
63	63	electronic device prohibited under sub. (3).
64	64	(3) PROHIBITED APPLICATIONS AND ELECTRONIC DEVICES. All of the following
65	65	mobile or online software applications and their successor applications and all

89	89	developed, owned, or provided by the following entities, or a parent, subsidiary, or
90	90	successor of the entity, are prohibited software applications and devices:
91	91	(a) TikTok.
