1010 AN ACT to create 7.53 (5) of the statutes; relating to: broadcasting election night

1313 Under this bill, if a municipality broadcasts canvassing proceedings live in any
1414 election, including by live stream on the Internet, the municipality must record the
1515 broadcast, and the municipal clerk must retain the recording for 22 months.

1818 The people of the state of Wisconsin, represented in senate and assembly, do
1919 enact as follows:
2020 SECTION 1. 7.53 (5) of the statutes is created to read:
2121 7.53 (5) LIVE BROADCASTS. If a municipality broadcasts canvassing proceedings
2222 live in any election, including by live stream on the Internet, the municipality shall
2323 record the broadcast. The municipal clerk shall retain the recording for the period
2424 specified in s. 7.23 (1) (f), unless, in good faith, the municipal clerk is unable to retain
2525 the recording because the recording is maintained on an Internet video streaming

3636 service that goes out of business or is otherwise removed from the Internet, if the
3737 service has been in operation for at least 10 years and has at least 1,000,000 account
3838 holders at the time the municipal clerk posts the recording to the service.
